lift of stay and chap 7

ok, so my 341 has come and gone, and the day before was the hearing for the lift of stay on my car. I did not object, so as of 2/26, they had the right to come get the car, per the court's signing.

Well, well, well, here we are march 10th, and it is still here. I canceled the insurance the DAY the judge signed the order and took my plates off, and parked it. it is ready to go. I got a letter from the bank saying they need the full balance by so and so or they will escalate, and at the bottom it said they are not trying to collect from me, since they know I am in bankruptcy.

So, um, how long till they come get the dang thing?

Unfortunately there's no way to tell. Given the state of the economy your lender may have a backlog of repossessions right now and not be anxious to add another car repo they then need to sell at auction for a large loss. Might be better for their bookkeeping to leave the car with you for a time.

Ask your lawyer if he/she minds if you call the lender and ask when they plan to pick up the car. Even then you may not get a solid answer.

i had a feeling that was part of it. it is americredit, and they have a high repo rate.
