    Question about private Student Loans and the 2005 BK Law Changes

    Ok- so I am new here. This is my first post. A little background for you... I filed bk back in June 2005 and it was discharged in September 2005. One of the debts that was discharged(I thought) was a private student loan for around $8000. Today, I get a phone call at work from an attorney representingTERI(The Education Resources Institute) who is the private holder of this loan. They said that this loan is not able to be discharged and they start asking what are my plans to repay the loan. I told them the debt was discharged 2 and half years ago. I did some research and found that a new BK law was passed, effective October 2005 making all student loans undischargable, however my BK was discharged in September 2005.

    Sorry for the rambling....but I guess my question is why are these people calling me over 2 years later telling me that this debt was not discharged? Can they do that? It seems like my attorney who represented me in the BK would have known whether this debt was dischargeable or not.

    Any advice or guidance on where to go for answers is appreciated.

    You need to call your attorney and ask him to deal with this collector!
