    Another PACER question...

    In PACER, there is a "request for notice" from GMAC mortgage.

    In the "Filers" section, there is my husband (debtor), myself (joint debtor) and, now, GMAC as a creditor. Why is GMAC a filer in the BK?

    Oh, they are also listed in the parties section. Could it be that they are our HELOC holder and we are filing BK on them and foreclosing on our home?

    DP, a request for notice is just that, a request that GMAC be notified of any activity in your bk.

    Because they filed a motion (acted in your case) they became a party to it, as well as a filer. Creditors who sit back and do nothing at all are neither parties nor filers, to the best of my understanding (someone correct me if I'm wrong, please ).

    But all in all, not a big deal. I think that their request for notice is probably because they want to know what the primary mortgage holder does; a secondary mortgage gets the crumbs of the first, if any, in a foreclosure. Good luck!!!

      I kind of figured that...they want to get something (but it will be nothing) from the loan.
