    Question about buying new car BEFORE filing for BK! >

    Question in regards to vehicle problem... I have alot of equity in a vehicle I currently own... owe $4600 and car is probably worth around $18000.00. I am probably going to down grade to a less expensive new car and want to see if I will face any problems buying a new car, well financing, a new car before I file for bk.. I will not be filing probably for around 6 months...

    I am going to put down around $4K, pay off the lien holder which is $4600 and use the rest for the bk attorney, around $2K, dental work around $1500 and use the rest to "live" for the next month or so...

    Does anyone here see any problems with doing this? Also if I have filed my taxes, am getting back around $6K, how can I spend this money without problems? At this point I am not going to file for at least 6 months, if at all, so do not want to get in trouble for going out and spending some $$ on a new computer, ect..

    Somone please give me some feedback on this... I am so stressed in regards to this situation that I am in that I am lucky I have yet to suffer a heart attack... I am a sick gambling adict and am probably going to lose everything due to this situation, my home, my new car, however can always rebuild I guess.. am young enough to start over...

    Last major charge was back in the end of Sep 07, made a $22000 cash advance, flew to Las Vegas to try and win my money back and lost every penny... Not a good situation.... am still paying back the minimum payment on a $30K balance and am hoping that there are no problems when I file my chapter 7... I was so stupid for doing what I did... I am trying to help myself, attending weekly GA meetings and going to one on one therapy once a week.. I hope that I can present this to the BK court when and if I file...

    my question would be this: are you still working? if so, then why would you need the cash to live off? that is a question a trustee may ask.
    You should consult an attorney re: your bk planning before you do anything with repect to the car or spending cash. given your situatiob you may need to plan on paying a bit more for your attorney than the average filer...just a thought.
    This is all fixable as long as your treatment is succesful.
