Igor, even if you're not a U.S. citizen you have the legal right to declare bankruptcy.

As for moving to another country, unless there are criminal reasons why you shouldn't leave the United States, you can do whatever you like. No one will stop you at the border. But bad debts tend to follow, and I have heard that U.S. based creditors DO pursue collections in other countries, so if you owe a great deal here it may well be worth it to you to declare bk.

Many bk attorneys offer free consultations. You don't have to sign up to get the free advice. Why not talk to a few and see what they say? You can tell them whatever you want, and it is protected by attorney-client privilege: they can't tell any one else. So you have confidentiality, and I think you could use their advice. Good luck!!!

declaring Bankruptcy is a legal remedy, and anyone has the right to use it. I was very scared when I first thought of it. I learned a lot by reading the "Tactical Bankruptcy guide," ans many of the posts here. One of your best weapons is being well informed. Then I wasn't so worried because I knew what I had to do and what the law would expect of me. Good Luck!

Heck, I ran to another State and all the creditors followed me (I moved from VA to PA)! Got myself a mailbox and before I knew had all these collections letters in the mail. I moved back from VA in a matter of a year, and found out I could file BK (life was much easier than when it came to filing (early 90's) that is.))

Mom, you're absolutely right -- good call. I had forgotten about that entirely because it doesn't apply to me, but that can be a *very* big deal depending on the country....
