    HELP ME...??s about 341, & bonus

    Hello all!
    I have finally paid my attorney -so my case has been filed-and my 341 meeting is Weds 1-28....so here it is my attorney isn't the greatest -very slow returning emails, not answering all the questions I ask him, etc.... so I had given him my paystubs up untill 12/14-i got a bonus on 12/28-sooooo I did not include this and it will put me over the median for Massachusetts-i emailed him about this and he never addressed the issue...what do you guys think- am I going to get in trouble-I am nervous about the 341 meeting anyways.............any advice appreciated....Thanks!     Colleanbean (cute name ) it really depends on the *date* your bk was filed. If you got that bonus even a day after you filed, it's irrelevant to your bankruptcy and not considered a part of the bk estate. If you received it before (or even the day of) your filing, then technically it should have been included.

    May I make a recommendation? At the top of each forum there are stickies (fixed threads) and you'll see several regarding PACER, which is an acct you sign up for through the federal court system and it gives you online access to bankruptcy filings, including your own. It's $0.08 a page to look at your stuff, but if you run up less than $10.00 you don't even get a bill. I think it would be a really good idea for you to get a PACER acct, if you aren't familiar with what the atty's been doing and you'd like to track your own case. You can even sign up tonight, if you want; there's no wait. See the stickies for more info. (If you already have one, my apologies ) Good luck!!!!

      You mention something lots of people mention - their attorney is slow in responding to them. Please note that while there are some bad attorneys as there are individuals in other professions, the majority of attorneys have nightmare schedules and do the best they can for all their clients. They may also need to research your question or contact someone else before they get back to you. They are not ignoring you; they will get back to you or have their paralegal or assistant get back to you. My favorite saying is "Legal Wheels Turn Slowly" and that is true for the entire legal and court system as many of us know. Attorneys get hundreds of emails a day (I know I work in a law firm). I have one suggestion that always works if you need an answer quickly; find out the name(s) of your attorney's paralegal or assistant and contact them instead of the attorney directly. Obtain their email if you can. When my BK attorney did not get back to me in a considerate period of time, I would then contact his paralegal who got back to me with an answer usually the same day.

        I agree with Flamingo...my attorney is swamped so I use his paralegal. Funny when I call, I ask her the question and she calls over her shoulder to ask him the questions (tag teaming in a small office).
