Hi just some quick ones. Lately I've got creditors telling me they are looking into my business assets some of which Furniture fixtures I had to throw out or give away. The only things I have left are tanning beds and booths that are all dismantled in storage. My question is if I go bankrupt and trustee take possession of beds where or who will he sell to because I've been trying so I can pay off debts but no ones buying I'm even considering selling as scrap because storage is expensive what do you guys think? Thanks

Well if you don't pay the storage bill doesn't the storage unit have the right to sell them. Seems to me that the storage problem and inability to sell the beds could solve itself. If you are planning on BK and you don't want the beds I would not pay storage for them. Save the money.Filed!!04/23/2008[X] 341 5/27/2008[X]Converted to asset case 5/26/2008 [X]

Hopelessly, it occurred to me as I was reading your post that maybe you're trying to get real money out of them; if you advertised them locally for next to nothing and invited the buyer to reassemble the purchase, I bet you could off load them. Who wouldn't want a professional tanning bed for $25 (assuming one is into that, of course). Even if you make less than $200 on the whole lot, you're no longer out on the storage fees and you don't have to worry about defaulting on the rental agreement or trying to figure out how to "surrender" all the various parts to the trustee.
This may not work or you may have already tried it, but it was what occurred to me as I was reading your post. Good luck!!!Nolo Press book on filing Chapter 7, there are others too. (I have no affiliation with Nolo Press; just a happy customer.) Best wishes to you!
