    On the road to bankruptcy

    Hi all,

    I'm about $75,000 over my head, with about $50k in unsecured credit cards/loans. Late last year I made the decision that enough was enough and even with my salary, I would need about an additional $1000 a month to even try and pay off my debt in a reasonable amount of time. I made a lot of financial mistakes in the past, plus I was married and encountered problems there which didn't help financially later on. Now, living on my own there's no way I can make ends met and pay off any debt, and at least have a little left over to enjoy life.

    I decided I need a clean start, so in November I sought the counsel of a bankruptcy lawyer. At that point we determined that I should wait about four to six months in order to get my income down closer to the median. I had done some outside consulting a few months prior, plus there were a few quarterly bonuses throw in from work which really jacked up my 'average' income. Though, the reality is I'd barely have enough to get by.

    I've also pulled the trigger on not paying anymore of my debts, call it a New Year's resolution of sorts. Most of these I stopped about a month or two ago, and yes, the calls are already pouring in. In fact, today I got my first collections agency letter for an outstanding debt of $464.

    Honestly I'm really worried about the process. It's only a matter of time before all my creditors begin to gang up on me and come after me, but I know it'll be worth it to stick to my guns.

    So right now I'm looking at starting the process in April, unless I end up getting sued by a creditor before that.

    Hi Tabula. As a newbie myself here, I will tell you what I have discovered in just a few short weeks.

    Once you have made the decision, it gets easier. I literally just decided right before Xmas that I had to file cause I just couldn't do it anymore.

    I am in the same boat as you on some waves. 75K (though all of mine is unsecured) and no way to tunnel out ever. I denied my situation for the last several years, which just got me deeper into the hole.

    When I finally came to the realization that I seriously could not do it anymore, I started looking on the web for information and found this site...can you say MOTHERLOAD? Anyway, what I am trying to tell you is that you are not alone and you will start to feel better as you gain more knowledge.

    I haven't cried yet and I wonder what is wrong with me. I retained my attorney today and during the meeting there were a few tears threatening to cross the border but they didn't make it.

    As far as the creditors ganging up on you, there is plenty of good information on this site that will tell you how to deal with that. Tomorrow I am putting my phone back on the hook and will get some warped satisfaction telling these people to CALL MY LAWYER!

    Don't worry, you'll get through it. Seek the support here when you need it.

      Looking through this site makes me both hopeful and scared at the same time.

      Like you I denied the situation or figured somehow I'd manage one day, but not so much. When I finally sat down and added everything up I realized I was in it deep.

        There are so many misconceptions about bk that most of us are scared to death to even consider it until the last possible moment. We were $64k in debt and my husband had just lost his job. I decided to do a little google search on bk- I was actually looking at the screen with my hands over my eyes like I was watching a scary movie!
        The best thing we did when we decided to file was unplug our home phone, then disconnect it. We both have cell phones, and disconnecting it saved us some money. Only one card figured out one of our cell phones and they weren't that aggressive.

          Yeah, that adding up thing is a *****. I thought mine was about 60K until the other day...I just really added it up Sunday and it is 75. How did I get 15K more in debt just by adding it up?

          Damn, I hate actually having to look at stuff.

          I know eventually I have to go look at my credit reports but I just don't have the stomach right now.

                Man, I so understand about disconnecting the phone. What I did was turn off the ringer so I couldn't hear it at all, and everything went to voicemail, which would get deleted instantly if it wasn't a voice I knew. And the credit bureau thing as well... I had to pull that at one point and man, that was a bad day. I can so understand not wanting to see it.

                        Roughly: clean slate (in Latin).

                        It has some deeper philosophical meanings, but that's kinda the idea.
