    Post 341 questions

    So all went well yesterday, but I have one question. The Trustee said turn over your tax return. No problem. I'm going to call her office and clarify. Does she just want to see my actual return or my check. Probably my check, but hey, it doesn't hurt to ask.


    Anyway, on to my other question. My exemptions listed 25% of my expected paycheck as non-exempt, therefore property of the estate, right? So shouldn't the Trustee have addressed that at the meeting? Like do you have the $300 to be handed over. Am I to assume then that it was such a small amount in comparison to my debt that it wasn't worth collecting? It just dawned on me this morning that it wasn't addressed in the meeting.

    I was under the impression that items like that were discussed at the 341, and then you contacted the Trustee to make the arrangements at a later date. At least that's what I observed with the people before me.

    Life, glad to hear your 341 went well!! When you call the office, don't bring up the paycheck: I have a feeling he's letting you keep it, because he hasn't asked you for it either at the 341 or in writing. You can safely assume that if he wants it, he'll ask for it (like your tax return) so don't offer it. But pay earned *after* you filed isn't a part of the bk estate anyway, so it's just 25% of one paycheck, right?

    My trustee said exactly what he wanted up front in writing; there were no questions. And mine wanted the actual tax return check (not that I have one to give). But if you haven't heard about it yet, I'd think it's safe to say you won't.
