My mom would like to give me a gift of $10K, but I also want to file BK7 in a few months. She also gave me a $10K gift last year. I didn't even think about reporting it to my attorney. Should I wait until after BK to receive the gift? I could really use the money now since I am surrendoring my home and am in the process of moving into a new home.

Have you mother pay bill directly. Do not accept the money from her. It will be counted as income and could put you over the median. Consult your attorney to be sure, but I do not think it is a good idea.
As far as the last year's gift, as long as it wasn't in the last 6 months you would not be required to report it.

Remember, if you need her to pay any of your bills, including your BK attorney's fees, I don't think that would be a problem at all. I just think she would need to pay the bill directly from her account. But again, I would pass it by an attorney to be sure.Chapter 7 Pro Se....Discharged Feb. 2006
