Need Quick help!

We just received a notice in the mail titled:

Notice of Missing Documents to Individual Debtor.

It is a notice stating that they are missing our certification of Completion of Instructional course concerning financial management. (official form B23)

The notice says we have until 1/9/08 to provide the document or else we may get an automatic dismissal of our case.

I am SOOOO confused- I thought I had until after my 341 meeting (Jan. 14th) to finish the course. We did the pre-counseling, but we were waiting to get the holidays out of the way to take the test.

Any advise?

First of all don't panic. Call your lawyer. You do need to complete the course, but it can be done in a half hour or so. As long as your attorney is still in contact with the trustee, you will be okay.

Crystal, I'm confused too. Form 23 is for the post-filing credit counseling, and yes, you do have 45 days after the 341 to complete it. The pre-filing you would have needed to complete before you filed, obviously. Not sure what you meant by not taking the test, but in any case, if I got a letter saying fix this in __ days, I'd do it anyway.

Isitreal is right, call your attorney's office and see what they have to say. It's a quick fix, as he (she? sorry) pointed out. Good luck!!!

ok guys- here is my update!

I called and fuond out that the wording of my notice is VERY misleading. It states that you must have items 1-5 completed by 1/9/08. Those items aren't even listed on my notice- because I have already taken care of them. The only thing listed is ITEM 6- which is to finish the debt counseling- and Yes I do have plenty of time left to do that!

Whew- I didn't mean to stress out-but every little thing is stressing me in this bancruptcy- I will be so relieved when we can join the 60 day club!!!

Crystal, I completely understand. I did my debt ed two days after filing just so I could sleep again. Seriously. Just knowing it was undone when it could actually BE done was making me crazy. But that's me.
