I have a cash question. Will the trustee scrutinize any cash or ATM charges prior to filling? I have stopped using CC's and have been keeping receipts using cash or ATM card. I am basically using the ATM card for food, gas, etc but did have a few small purchases for the holidays. So will he look at bank statmnets for several months prior to filling to see if you were trying to hide money, etc?

In my opinion, no. He cares about the balance in your account the day you filed. He cares about transfers, lawsuits etc. But you need to live too. Paying your bills with your debit card is just in the course of business and living. Unless you are spending thousands each day, I would just go on living (and keep balance low in account on filing day including uncashed checks etc)

We have to produce our bank statements for the last 6 months and yes we were told the trustee is looking for unusual patterns. Something like, "gee you are filing for BK but I see you with drew $3000.00 2 months before you filed." Where did the money go?
Basically, the trustee is looking to see if you are fraudulently hiding monies anywhere. Using your account for normal living expenses and Christmas is reasonable. Provided you didn't buy a new $2000.00 plasma TV that is.
