    Closing Credit Union Accounts

Just received a letter today from our former credit union explaining they have closed our checking accounts and transferred any balances to our savings. This is due to our BK. We are BKing on a credit card from them and an unsecured loan.

Instead of going in person, can I send a letter asking them to close all accounts and send us a check? It is not a lot of money, maybe $100 total.

    Thanks in advance!

They should honor a written request.

Are you saying that they did not steal/cross collaterize your accounts by now since you filed on their products?

Probably depends on their policies. I just closed an account with Citibank over the phone and they sent me a check for the $6 I had left in it.

They did not 'take' any money out of our of our accounts.

I believe they are not allowed to do that AFTER you file. We cleared most of the money out of the accounts and switched credit unions before we stopped paying them. Therefore, there wasn't much to take and they couldn't as we filed shortly after moving our accounts.

By they way, thanks to this site for the great advice! Without it, we may have been screwed with the "steal/cross collateral" issue.

PLEASE NOTE: I am not a lawyer. Bankruptcy may or may not be a best scenario for you. It depends on your situation. You may assume my advice is totally useless. Talk to an experienced bankruptcy attorney (or three) in your jurisdiction for legal advice.

I don't understand your use of the work "steal" when describing a legal obligation you agreeded with at the time and you signed a contract to that you would do.
Would you please explain why this is stealing?
            regards,

emoney, I don't know about yoyoma, but let me present a scenario:

If you say you are going to give me $20 and then you don't, but a few days later I spotted your wallet and TOOK that $20 without notifying you in advance, plus a $10 pissy fee because you didn't honor your agreement, and waited for you to find out when you were in line at the pharmacy and found yourself with an empty wallet... would you consider that stealing?
Nolo Press book on filing Chapter 7, there are others too. (I have no affiliation with Nolo Press; just a happy customer.) Best wishes to you!
