    Sending documents to the trustee

    I'm almost finished getting everything together for the trustee.

    My docs have to be at his office no later than Dec 24.

    I'm wondering if it's a bad idea to send them return receipt so I know he got them? The address is a po box.

    I'm in the same boat as you are: have to get docs to the trustee by 1/8, but cannot drop them off or fax them according to the trustee's instructions. Address is a P.O. Box.

    Since you can't do a return receipt to a P.O. Box (no one to sign for it) I have decided to do a Proof of Service by Mail; a neighbor has agreed to help me with that. Basically, it's where you get a friend to sign a document that says "I placed these docs in this envelope with postage prepaid and sent it to this person at this address..." etc.

    It won't get the mail there any faster, but when they sign it you take it down to the courthouse and file it as proof that you SENT it. I personally don't care when he gets it nearly as much as I can prove I sent it, and what exactly I sent.

    If you have the Nolo book there are sample "Proof of Service by Mail" forms in there you can adapt as needed.

      You can get return receipt on PO Boxes. A notice is placed into the box, and when the mail is picked up, they take the card to the clerk and receive the mail. Works just the same as if you received certified mail and were not at home to accept it. I sent my tax returns to trustee at his PO Box and had no problems. And the return receipt comes back to you so you have proof it was delivered.

        I'm planning on sending the package with a certificate of mailing. I believe my instructions state not to mail with a signature confirmation.

        A certificate of mailing is filled out at the post office (usually by the postal clerk) and *I think* has the address you're sending the item to, along with a post mark.

          Thanks for the correction -- I didn't know that. I think I'll do that AND the Proof of Service by Mail.

            BTW, Genseeker, were your tax returns the only thing you had to provide? I have a list of 20 items (not an exaggeration) to provide to the trustee by Jan 8 or explain why I can't provide. Not only tax returns but W2's , pictures of my vehicle (plus tag, description, insurance declaration page), check carbons for the last year, copies of any checks or money orders > $500 in the last year, bank statements, marriage certificate if you have EVER been married, divorce papers (all of them) if you have EVER been divorced, support agreements, on and on and on it goes. And all of this up front, before the pre-341 phone conference (I posted elsewhere about that), before the 341. If I get a chance, I'll post the list. It is impressive.

                Wow, that is a lot of stuff. I have to provide ledgers because I'm an independent contractor. So, that will take me time to make them look nice, cause I don't think he will enjoy my handwritten ones.
                I was waiting on bank statements, which I just got.
                I thought the list of 8 things were bad, but wow, I'm not having to do that much work.

                  all my trustee asked for was tax returns. ours was a very basic BK7. at the 341 he did ask for proof of the lien on the vehicle and it had to come from DMV. I took copies of car titles, bank statements and all kind of stuff with us to 341 and ended up needing none of it. a lot of our debt was medical or utility related

                    Nope; it came in a form letter so I assume it's the same for everyone. Mine is a straightforward no-asset Ch7. I went through foreclosure earlier this year which makes everything much simpler, and no credit card transactions since last January (when I figured out I couldn't pay them, I quit using it). I have $6 in the bank right this very minute.

                    As I posted in another thread, this guy is a real go-getter...

                      Okay, I stuck this list up on the web. Please PM me for the link. I posted the direct URL but then thought better of it, since I really have no permission to "publish" it on the net and God forbid I piss off the trustee. It ain't purty, but it should work. Now I think it will be obvious why I keep using the word "firehosed" in relation to this situation.

                        I got a form letter too. Since they get a percentage if they can sell something, then they are looking for stuff.
