    The tax refund is the amount you over-paid. The government owes it to you. My understanding is you are free to do with that what you want to BEFORE you file.

      True. If you wait and receive the refund after filing, they may likely take it anyway, so you're much better off using it for your attorney and whatever else you need before you file. Then your assets don't include $700 sitting in a bank account. If you spend it on necessities (attorney, groceries, repairs, living expenses, those sorts of things) it'll be fine.
