    creditor calls

    I have a question regarding when to let creditors know you are going to file. I met with an attorney and will be filing ch7 in april 08. He said to quit paying ccs and when they call tell them "I cannot pay you anymore, I have hired an attorney call him at...". My question is should i dodge the phone calls via caller id til i get closer to April? If i tell them now i am thing about bk, will they just ramp up their legal team to try and sue me as fast as they can? I think this might be the longest 6 months of my life...

    We stopped paying in ###### and still answer the phone calls. It seems like answering them helps keep the calls from getting crazy. I've continued to tell them that unexpected medical expenses are the reason I can't pay.

    Discharged November 2008 100 days after filing no-asset Chapter 7. We intended to let a two-year-old vehicle go back to the bank and reaffirm an inexpensive ten-year-old SUV and our home mortgage. In the end we surrendered ALL of our vehicles and reaffirmed NOTHING. We'll "ride through" our mortgage after the court ruled it an undue hardship.

      My advice is use your caller ID and don't talk to anyone. Don't even tell them you are filing. Just ignore, ignore, ignore. They hear it every day that ppl are filing and imo, it doesn't do you one lick of good to say a word to them. Just ignore!
      11/14/07 -filed C7 12/04/07 -case pulled for random audit.12/18/07 -341 held: Asset case due to engagement ring & tax return.02/19/08 - US trustee files motion to extend. 04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!

        All ignoring them will do is keep the calls coming full steam ahead. I would answer them. Give them the name of your lawyer and number. The ones I gave the info to stopped calling. I don't think telling them you're filing will make them run to the court house to sue you. Most of them seem to do nothing for 6 months anyway. Tell them and be done with it.

          We stopped paying in January. Hired our attny end of March, first of April.

          As Creditors called, we told them we were filing BK. Gave them our attny's name and contact info.

          Calls dropped off for a while. About 2-3 months later, the calls picked back up again.

          I answered the phone one day and told the Collections lady again that we were filing. Attny name and contact info. The Lady said, "You told us that 3 months ago! Are you really going to file??!! If you are, you should tell your attny to get off his duff and get your case filed already!" And she hung up on me.

          We finally filed in September. 6 months later. So I know full well what you're gonna go thru.

          It's kind of loose/loose whether you tell them or not. Some won't quit calling. Others will quit for a while and start right back up again.

            From what I've read in the forum the last couple months there hasn't been any "actual" issues with giving your attorney's info out many months in advance of filing and several folks have reported the phone calls dropped significantly as soon as they gave out the attorney info.

            Has anyone experienced issues with giving the attorney info our early ? What were they ?

              I stopped paying since June. The calls come in from 8am to 9pm somewhere between 20-30 calls a day. I just put my cell phone on one beep and that takes care of the call. I let friends and family know that I'll call them back if I see them on my caller ID.

              At first the calls came with alot of automated voicemails. I just listened and deleted those at night after the call was free. Now the voicemails are much more infrequent, but they are from a live person. I notice that some companies call every 20-30 minutes all day long.

              I've gotten used to it.

              I plan on filing by the end of the month

                I gave them the runaround. When creditors started to call and started hassling me I told them that I was on my cell phone driving, and that I didn't have my attorney's business card with me. When they asked me to call them when I got home, I again told them that I was on my cell phone, driving, and could not get a piece of paper/pencil/pen out and write it dowm their phone #. This worked just fine until the day that I actually did see an attorney.

                  All of the attoneys we met with for consultaton were very adamant with us that you are not protected from creditors until you have a valid docket number from the BK court. They said that telling them that you plan to file may make them jump to file a judgement right away.
