    I hate my apartment!

    I really despise the apartment that I live in and I'm currently in a lease. I am going to be filing for bankruptcy in the next two weeks. Hopefully it's going to be a chapter 7.

    I am so tempted to include my lease in the bankruptcy and get the heck out of here. I found a townhouse for rent today and owner approved me. I was thinking of using my November rent money to pay the security deposit and get the heck out of dodge.

    Any thoughts on this?

      I believe your plan stinks. BK is serious business. It will be with you for the rest of your life. If you really need to do it, OK but for an apartment you do not like is not good planning.
      Besides you may get on a list that apartments use and you will not be able to rent anywhere.

        I am filing regardless of my apartment. I was just contemplating including my lease in it.

          If you are fully approved for your new place you may be clear to move. Most apartments use a service like a CRA, except it is for rental history.

            Once you get your name on SAFEFRENT (the Consumer Reporting Agency used by most rental agents) you are doomed for renting for 7 years! Think twice before you smear your name in the rental market!!! Take it from someone who did!! (me) You will be sorry. Contrary to popular belief there aren't just three major reporting agencies. There are also major ones for insurance, apartment rentals and more. See my link from a previous post. I think that sometime you have to make decisions on moving during BK, but I would think twice for the reason of just not liking the apt. Stick it out a little longer and make it easier on your self in the long run. A BK is easy to explain but a broken lease is almost impossible to smooth over! Good luck in making the right decision. I know its hard! And then we all give you our opinions and it makes it even harder!

              We filed against our previous Landlord and so far, it's worked OK.

              We were having problems with the septic system of the house. The Landlord kept claiming it was us. One of the repair guys said their system was not built to code and that's what was causing the problems. After several rounds, we decided to find a new place, chuck the lease, and leave. We included our Landlord and the remainder of that lease in our BK.

              Our Landlord was an individual tho.

              So while you can do what you want. Move on and include the current lease in your BK, as Cindy pointed out, it could come back to bite you later.

                  You got good advice BOTH ways. We used to be landlords and used a service like someone mentioned. If someone had a bad rental history we didn't rent to them. Period. We didn't even bother asking any questions.

                    Just out of curiosity, if someone paid rent all the way up til they filed BK, then had it included and moved asap, would that be seen as bad? (meaning, not owing back rent and letting your landlord know you have to file.... still paying up until the day you moved out... but none-the-less, leaving before the entire lease is up?)

                    Wait a minute... did that make sense to anyone other than me???

                      Well, if it's paid up, there would be nothing to include, unless you're talking about the balance of the remaining lease being included.

                      As a former landlord (of one rental house only, not a slum lord), and having been burned by deadbeats repeatedly, any bad financial background would have turned me off.

                      Now that I've been through BK, I might be a little less fearful of that situation, but I would have quite a chat with the people, to feel them out.

                        they mean paid up for the month but a broken lease is a broken lease and will be reported as such. the balance will be zero once the discharge is received it will e reported as iib, but can still be reported as broken lease.

                          Another thing is just to talk to your landlord, if you are basically moving out either way, let them know and perhaps they can rent it out before you move out and not cause hardship either way.

                          Communication is key.
