    Business/Personal-his name, not mine, yikes!

    Let me start with we are in Wisconsin, which is a super crappy state for just about everything other than the Up North Ambiance, so that might make a difference since we have common property/marriage/etc.

    My husband's job at a corporate office was downsizing, they offered him a franchise, he bit.

    It wasn't the smart thing to do.

    6 months later, he realized why they offered it to him. They even bought it back it sucked so bad, even being a nation-wide name.

    But he carried over some debt from a food distributor, I believe about $8-9k?

    And suddenly, he's telling me WE have to pay this back.

    Put a dunce cap on me and put me in the corner, I thought LLC status meant no personal responsbility should the business fail, you could declare business BK.

    So here we are...

    can the business just declare? We have to as well? being a common property state, does this mean he can't declare on his own?

    We're so wishy washy about going to a BK lawyer. We have our own personal debts that stockpiled after he lose the store and was out of work and then making only $250 a week at some crappy job. Can that business stuff and ours be combined?

    I think ours could probably be managed slowly but surely...but the food distributor has made payment negotiations that still don't come close to meeting our monthly budget. Plus my husband is at a 90 day temp job making the absolute minimum we need to survive with rent/car/utilities/etc/etc. Come 90 days, he could very well be out of a job again.

    If your personal life and your business financial life is intertwined then you need to sit down and talk to bankruptcy attorney that also handles personal/business bankruptcies.
    Many of the questions you need answered can only be answered by an attorney.

      Did he personally guarantee the debt?
