    Filing October 1st...getting nervous

    Will be seeing the attorney today to pay her the remainder of what I owe her. At that point, we will be given the information on taking the online credit course to complete this week.

    October 1st, we file Chapter 7. No turning back after that. I really hope this is the right thing to do, but either way, we have no other choice but to do this. Didn't think I'd get nervous at this point. Been pretty excitied to get this over with up until now. Oh well, no more bills once this is done right?

    Don't cut things too close on doing the required pre-filing course. Depending on who you choose to use, it can take up to five days to get confirmation back to your attorney. Take the course asap if you are planning to file Oct 1.

    Oh well, no more bills once this is done right?
    You'll still get the excitement of opening all your utility bills But no more credit card or unsecured loan payment demands...those will disappear out of your mail quickly. Any you receive more than a month after filing, take those to your lawyer who will send the creditor a stern written warning about violating the automatic stay by demanding payment

          Oh I was a nervous wreck throughout it all. Looking back, I can see where that was so needless.

          Yes, NO MORE BILLS.

          Filing BK is the best thing I ever did for myself. I wish I had done it much sooner than I did. My health really suffered throughout the couple of years prior to making the decision.

          I've yet to read about anyone who was sorry they filed. Life is great now!

            My timing is about the same as yours. I'll probably be filing the second week in October. I feel like I'm making the right decision but I have to admit I'm getting nervous too. It's just that it's such a huge life changing decision and not knowing exactly what to expect is nerve racking. This forum has been a huge comfort, though. It's nice to be able know so many other people in my same situation.

              I can totally relate. We paid our attorney last Friday and have already filled out the paperwork. Just need to take the counseling course online and we're done (until the 341 meeting). I have that "nervous" feeling too....I know there's no turning back now because A. I paid almost $1,800 for services already and B. I let my perfect credit history go by letting some of our bigger bills go unpaid starting this month. I can't believe we are only 2 weeks late on one of our big credit cards (at&t universal card) and they are ALREADY calling 2-3 times a day.

                im nervous as well....paid my attorney today $250 to retain her...im going to take the prefililing counseling class tonight or this weekend.....and i will pay her the remainder fee on the 15th of oct.....thats 2 weeks......i cant wait.....these collectors are burning up my work phone...and my auto finance company has left very rude and threatening to voicemails on my moms phone....i told her keep them just in case....

                  Glad I'm not the only nervous one. My problem is I just don't recall how many balance transfers we took in 2006 but Im pretty sure there were several, and what worries me more is there may have been a couple in early 2007 too, but I just don't recall and I don't have the records or them. Im SURE there were none in the past 6 months, though. So hopefully we'll be okay.

                  As for filing bankruptcy being the "right thing to do" I KNOW it is, considering all our debt. We'd NEVER get out of it without filing. So all I can say is, I hope all of us have a GREAT (EASY!) 341 and then everything goes smooth and this will all be over SOON!

                    I too have been a little nervous, but we're so judgment proof that we are really only doing this as protection against the unforeseen.

                    Think of moving on once this dam is removed and let your worry of your overwhelming debt cancel out the worry of potential 341 complications.

                    Our credit counseling was on-line and was start to finish 90 minutes tops (initial call to waiting for printed certificate that we printed the next morning). Some are very fast.

                      Right, the burden of all that debt for the next 10-20 years is such a burden that the burden of worrying over the problems that could arise in filing, are worth it.

                      As to credit counseling, unless your attorney requires you to use a certain one, there are plenty that you can do on the computer and get a print out of your certificate immediately after. We used www.cricketdebt.com and although the course itself was not very worthwhile, it does satisfy the requirement, and only takes about an hour if you hurry through it, and send the cert. immediately to your email address and/or your attorney's fax machine.

                        I can relate!! We filed last week, got our case number on Friday 10/5/07. I'm nervous about the 341 meeting, which I'm betting is normal. I'm just worried about the trustee. We got a large tax return in 2006, and alot of it went to get some bill caught up. I'm just worried that he will question that? Maybe I'm worring for nothing? If anyone has any insight on this kind of thing I would love to hear from you. Thanks so much.

                          Kris the Trustee will probably ask where it went, however if it went to pay bills etc then there will not be a problem. Just have the evidence for him there to show where it went like the bank statements for that month or cancelled checks etc.
                          May 31st, 2007: Petition Filed by my lawyer
                          July 2nd, 2007: 341 Meeting Held
                          September 4th, 2007: Discharged and Closed.

                            Your tax return was six months ago at this point so I really doubt that the trustee will be that interested in your 2006 return. What they may be interested in is a pattern of sizable returns and the possiblility of a large return for 2007. That could be considered an asset. Ask you lawyer if your trustee is in the habit of taking tax returns and find out if it would be a good idea to raise the number of dependents you claim in order to get a smaller refund.

                              Thank you, I did talk to our lawyer and he had us change what we claim so I think that we are good for 2007. I will take bank statement with me just in case he asks so I won't have to prolong the process. Thanks so much!
