    Attorney wants so much paperwork!

    I was wondering what everyone else's experience was with this. I'm about to retain an attorney that I've spoke with twice (a few months ago) and we've e-mailed a few times. However, he won't meet with me in person for the initial consulation until I have an intake form filled out (story of my life - 60 pages long) and a stack of mandatory documents - list is below.

    I've been working on getting all this information for quite a long time and my appointment is on Wednesday. So here are my questions.

    Is this standard practice for attorneys?

    Does all this paperwork get submitted with my bankrupcty or is most of this just to be filed at the attorney's office?

    A. INCOME/DEDUCTIONS:
    1. _____ Paycheck stubs last 6 months and any year to date. The stubs should
    have the following information. If they do not, then we will need documents
    showing each of the following.
    _____ Retirement or pension plan contributions in the last 6 mo.
    _____ Retirement loan currently owed.
    _____ Insurance that is being deducted from your paycheck.
    _____ Any mandatory or voluntary deduction from your pay.
    _____ Any wage garnishment order.
    _____ Commissions or bonuses received in last 6 months.
    2. _____ Unemployment, child or spousal benefits received in the last 6 months.
    3. _____ Soc. Sec. or SS Disability payments received by anyone in household.
    4. _____ Pension or retirement benefits received in the last 6 months.
    5. _____ Bank interest or stock dividend income received in the last 6 months.
    6. _____ Lease or rental income received.
    7. _____ If you have your own business, a year-to-date P&L Statement.
    8. _____ An itemization of Gross Business and expenses for one year .
    9. _____ Any monies contributed to household expenses by other household
    members.
    10. _____ Any other source of income.
    B. FINANCIAL:
    1. _____ Tax returns for the last four years.
    2. _____ 12 months of monthly bank statements from all financial accounts.
    3. _____ Last 2 (two) months statements for every bill you owe.
    4. _____ Utility bills for the past 2 months (Just the face page).
    5. _____ Last 2 months vehicle and mortgage statements.
    6. _____ The last 2 (two) statements for any IRA, 401K or medical savings plan.
    7. _____ Education IRA, Education Savings Account or tuition program
    8. _____ Any bankruptcy you filed in the last eight years.
    9. _____ Copy of any retirement, 401k or pension plan from Plan administrator .
    2
    C. MISC. INSURANCE: Declarations page for the following insurances, including
    agent’s name, address and telephone number.
    1. _____ Homeowners (property) or Renter’s
    2. _____ Articles
    3. _____ Health and Dental
    4. _____ All Insurance Agents’ name, address, telephone # and Policy number

    D. VEHICLES: (Cars, boats, quads, motorcycles, motor homes, etc.)
    1. _____ Contracts and leases during the past four years
    2. _____ Proper title for each vehicle
    3. _____ Registrations for each vehicle, motor home or mobile home.
    4. _____ Insurance (Declarations Page) provide agent name, address and
    telephone number
    5. _____ Kelly Blue Book values of vehicles. http://www.kbb.com/
    E. REAL PROPERTY: (Homes, Mobile Homes, Time Shares, Vacant Land, Burial)
    1. _____ Deeds of Property owned or transfer papers from last 10 years.
    2. _____ The last Property Tax bill for current ownership. (register of deeds)
    3. _____ Information regarding refinancing within the last three years.
    4. _____ Foreclosures, repossessions, garnishments, attachments 1 yr.
    5. _____ Copy of Recorded Mortgage (obtain from register of deeds)
    6. _____ Appraisals of real property in last 2 years.
    F. PERSONAL PROPERTY:
    1. _____ Documents concerning any personal property that has cash value.
    2. _____ Any document evidencing a Secured Transaction for the last year.
    (Secured Transaction is any loan secured by property of any kind.)
    3. _____ Copies of all titles.

    4. _____ Purchase contracts.
    6. _____ Appraisal, Ebay or classified ads showing value of similar property .
    G. DIVORCE / SUPPORT
    1. _____ Orders of child or spousal support or letter from family law attorney.
    2. _____ Dissolution Agreements or Stipulations.
    3. _____ 6 (Six) months evidence of payment of Support Obligations.
    4. _____ Support you owe that is secured by a lien on your home or other
    security.
    H. MISCELLANEOUS:
    1. _____ Face page from any ongoing lawsuit in the last two years.
    2. _____ Felony conviction information.
    3. _____ Distribution from an estate or trust.
    4. _____ Papers regarding any potential inheritance.
    I. IDENTIFICATION:
    1. _____ Driver’s License, State ID, or Passport (Must be current and valid)
    2. _____ A copy of your social security card.
    J. BANKRUPTCY BREIFING CERTIFICATE:
    Under the new Bankruptcy Reform, you are required to undergo credit counseling
    before you can file bankruptcy and also a financial management course is required prior
    to discharge. While there are numerous debt counselors available, here are a few;
    1. _____ GreenPath Debt Solutions, members of the National Foundation for
    Credit Counseling (NFCC) and the Better Business Bureau (BBB). You

      It may not be standard practice but it is a GOOD practice. The attorney is able to review "real" information from you and give you "specific" advice.

        YEP - basically this is all the information that they want to know if they take your case.
        He's being very thorough in what he's asking for, doesn't want any surprises. And it gives him a good idea of what kind of case you are going to have.

          I'd consider this a sign of a good attorney.

          I built a 3 inch three ring binder with just about all of this data, organized and divided per the above outline.

          Damn thing must have weighed 10 lbs.

          Worked great for me.

          I knew EXACTLY where I stood.

          And, when I walked in to my attorney's office, he absolutely KNEW I was serious and knowledgable enough to provide him with whatever he needed.

          It was obviously a "no bullshit" consultation, and we both were comfortable with the task at hand.

          My suggestion is you do the same.

          Then, YOU will be in control of as much of the process as possible.

          And, you will understand your position perfectly.

          There's comfort in knowledge.

            This is everything I needed prior to my appt......at that time was when she told me i did qualify for a Ch. 7.....i just need to bring updated paystubs as we go through paydays until I file.

              It's good to know this is the sign of a good attorney. I'm glad he's being thorough but it's been a lot of work getting all this together. It's a huge stack of paperwork! At least they’re going to make their own copies. How much of this paperwork is actually passed along to the courts?

                Great Idea...I read this and ran to Walmart and got a binder, 3 ring whole punch, and dividers. I am going to work on mine tonight I have a meeting with a lawyer on Monday morning.

                  My attorney wants all that plus 2 years of bank and credit card statements. He wants to have a good understanding of where the money went for the last 2 years. I'm having lots of fun trying to collect and reconstruct the last 2 years. This may be due to high debt, $200k.

                    Remember, your attorney is probably gonna want copies, not originals.

                    Don't be suprised if, early in the process, that your attorney's assistant calls you wanting documents...

                    Just smile and ask nicely if they have checked "the binder...."

                    They'll get used to it after awhile...

                        I think I have it all ready. The stack of paperwork is about 2 feet high! Good thing they're the ones making copies. My appointment with the attorney is tomorrow. I hope everything goes alright. He said I should be able to file Chap 7 but I think I'm right on the borderline...

                          If you thought that was a lot wait and see what the trustee might ask for. Nothing or lots of stuff

                          your attorney is required to ensure that the information on the schedules is correct. My trustee wanted a years worth of bank records and credit card statements and canceled checks. Then he changed his mind and said just credit card statements and proff for my tithing

                            We met with an attorney today who asked for about the same amount of documentation - 5 pages worth of lists. Granted I have most of it but really seems like a lot to gather at once.

                            I atke it as a sign of a good attorney trying to protect you and his firm from anything coming up out of the blue.
