    Monthly Expenditures/Allowances

    Ok I have been trying to gather the information to answer my own question by reading availavble info on here but I came up with nothing.
    (In advance, let me apologize if you don't understand - At times I have a tough time typing what's in my head )

    Here is goes:

    I am going to attempt to file a Chpt 7 alone (Dh will not). I know that a major factor in determining whether or not I can file for a 7is our income and our state's (Illinois) median income. When I combine my husband's and my median income we are below it. (I wish that was all there was and automatic 7 it would be) I know I still have to do my figures as in what I spend monthly etc. to see if I have any disposable income (correct?).

    Ok, when I am doing my monthly spend, as an generic example say Illinois has an allowance for food of $100.00. Does this become 1/2 since DH should be helping pay for such items?
    I mean they use his salary for the median test so I thought they did this as well?

    (Sorry, this is as clear as I can get the question typed! )

    That does not seem to have been updated yet since the old law which may be why you can't seem to make sense of that part yet... so I will give this my best rookie shot. This is my current understanding, not absolute answers.

    Certain questions keep getting the same answers, so I will give my best shot at this one & the mods & experts correct my mistakes, please.

    From what I understand that is correct. Disposable income over 100 could put you into a different BK. I have not gone through the entire formality yet. When my mom did it before any new laws she was above the median and the attorney told her that she needs health insurance because of her age and being right at the retirement age but not quite there for health benefits from S.S. She bought the insurance and this put her median minus her monthly allowance at the level she could do a 7. So, keep things like that in mind when you tally things on your own.

    I do not know what DH means. If they say 100.00 in your state for food, that sounds to me like per person. I don't see how many people could live on 50.00 a month food unless they eat mostly carbs. Yet some states allowances for that would not suprize me.

    From both of your questions combined I think you might have part of this mixed up though.
    A) In the first question you said you were filing alone and DH will not.
    B) Then in the second question you have DH paying/sharing expenses for food.


    If you are filing alone and DH, whatever that is, is not/will not, then you cannot look at DH income and food costs, you would just be looking at your own income and your own expenses and outstanding bills.
    It sounds like you want to file alone but want to use your own figures jointly with someone else, who would be DH and DH will not do that. (?)
    I doubt the laws will let you do that if that is how you are trying to figure things on paper.


    How did I do on those answers?

    Also, check out this article. It gives a vast list of things as expenses including the other bills, just so you do not forget any.

                DH will not what? Will not file alone? Will not file with you? Will file, but will not file without an attorney?

                and you would do it alone, like as in pro se?
