Hired a lawyer....Best Buy called....

We got our first creditor call since we hired him and we tried to refer them to the lawyer, they wouldn't take the number without us answering some questions.

I told them I wasn't going to answer any questions until I talk to my lawyer about it.

Sure I may just be over cautious, but the lawyer (well his Asst.) said that it won't hurt to answer the questions.

It was for Best Buy....over the last 3 years, we have charged a 42" TV, Camcorder, 2 computer monitors and Camera.
Computer monitors last winter.
Camera last Feb.
Camcorder last Dec.
TV 2 years ago or so.

I know Best buy has the right to the stuff....but how often do they really take it?

I won't be crushed if they take the stuff...but I would like to keep my camera.

The person on the other end was just strong arming you. Under the FDCPA, all you have to do is INFORM them you are represented by an attorney and tell them to contact your attorney...talk over the person if you have to, what they do with that information is up to them. If you are interested in pursuing possible FDCPA action against a debt collector...keep a log...i.e. take down the date and time of the call, who the party said they represented, and then notes on what you said and what they said.

When a debt collector does call you, you should provide your name.

Best Buy rarely repossesses the stuff you buy, so I wouldn't worry about it.

Yes, they will have the right to pick them up, but seldom do unless you just have bought them......

Things like this stuff looses value so quickly that within 90 days its obsolete.......

They may ask for them.... they may not..... a camera is just a camera..... you can always buy another!

The most important thing right now is to get your life back on track where you can "live" instead of just "surviving".....

Give them your attorneys name and number and hang up......

Best Buy's attorneys in Arizona filed a Notice of Appearance in my BK7...

Then sent my attorney a reaffirmation agreement for about $1500 worth of stuff.

Yea, right. Let me run over and do that, huh?

We laughed about it...

And shredded the agreement.

Best Buy acts the part, and almost never does shit.

If you had bought a big screen TV for $5K a month before BK, maybe they would do something.

Otherwise, forget them.

Even if they sqeek, tell them they can pick up their shit. It's all out in the garage, stored after it all was wasted in that plumbing flood last month...

Yea, don't forget to take the mold with ya, also.

yea i figured if I told them I lost the remote and the tv has paint splatter on the back of it (all the truth), I dont' think they'd want to come pick it up.

The camcorder was used once (yea that was a good buy ) and my camera has a different lense with it now, so it's not the same as i bought it.

I spoke with a creditor who bought my debt on a motorcycle and wanted to have them repo it. They didn't want anything to do with it and they have the title. Wouldn't even discuss it. They said it's a write-off to them. They would rather write it off then actually have to pick it up and sell it. I have not seen the thing in almost two years anyways as i am in a very different state. Oh well, that's twice I tried to give it back to no avail.

I would not give anything back unless someone in your
BK case says you have too, and I doubt you will... and
I still would not answer any questions, you do not have too,
refer them to your attorney verbally or written or both.

be sure and list best buy as and UNSECURED DEBT on your bankruptcy! they can dispute is if they want to but the won't. They are blowin smoke. Ask anyone on here. They are the same as Dell. They talk a big game but in the end do nothing.
