    Finally getting over a bout of depression due to my divorce last year & my...>>>

    ...decision to file bankruptcy. However, I should have file this past spring, but wallowed too much in my own depression. Basically, I go to work, eat, & sleep. My whole life is such a mess, in every aspect.

    Well, to cut to the chase - I've got to get on the ball & file. Turns out I can no longer get copies of my past CC statement on line (which I figured happened anyway due to the obvious status of my accounts). I'm certainly not going to call & get harassed, I'm trying to get myself out of this mental rut, not did it deeper.
    I plan on sending a letter asking for past statements (I've never received them via snail mail anyway). Will the CC companies actually send them? Will they insist that I pay for the copies that I never received hard copies anyway (always got them on-line)? If I say it's for legal purposes will they send them? They already know I am "going to file", I've already obtained & even fully paid my lawyer, now I just have to file. Is there a proper way to word my request via mail? Does anyone have a letter format suggestion for this type of request to the CC companies?


    Thanks for any suggestions anyone can offer.

    Welcome to the forums

    I answered your question best I could on the other thread. If you contact them they probably will use the information to harass you.

    I didn't have all my credit card statements either, so what I used was the credit reports to fill in the gaps that I had.

    Maybe that'll work for your case too.

    I was also depressed badly for about 3 years until this year when I finally decided to file. I wish you good fortune in taking back your life

      I'm new to this to and understand what you are going through. Just hang in there, we will all get through this.

        Ditto to the well wishes, and also ditto to the "depressed badly" before filing.

        My financial problems were SO bad I don't know how I ever survived the stress. Oh if I knew then what I know now...if only, if only. Once I saw an atty. and started putting together my stuff for filing, a huge weight was lifted. I feel SO much better now, and I'm not even discharged yet.

        My atty. told me, during our first visit, when I sat and CRIED to him, that even my health would greatly improve with the BK. How right he was.

          I absolutely agree with all of that - you start getting yourself into such depression that crazy thoughts start taking over...

          step 1 is what you did - see the attorney and ask him all these questions. Once you go delinquent, the cc companies don't seem to eager to help you with past statements, etc.

          See what your attorney says about this - if the trustee really wants to see them, now what? I actually could not give him everything he wanted to see for this very reason. What are you gonna do?

              I've been there, done that and got the t-shirt. My screen name says it all. Hang in there. If it's not one thing, it's another with BK. We've ALL been there and we are all here for each other now.
              11/14/07 -filed C7 12/04/07 -case pulled for random audit.12/18/07 -341 held: Asset case due to engagement ring & tax return.02/19/08 - US trustee files motion to extend. 04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!

                You don't need the CC statements.. What you need is your credit reports, which you can get a free copy from the 3 reporting agencies once every 12 months.

                The Credit Report will list all your credit card debts, store card debts, checking account overdraft, bank credit line etc etc. They do not contain debts from debtors who do not report to credit report agencies. So if you have debts from drs., vets, utilities, cable, landlord debt, your uncle Bob, etc, they are not on your CR. But you are required to list all your debts that you are aware of. You need to make a reasonable effort to list all the debts and creditors. But do not freak out if you don't remember every debt in absolute detail. If you are insolvent, with no asset, under Ch7, the with the exception of statutory non-dischargeable debts(e.g.student loans, criminal fines, traffic tickets, IRS etc), all non secured debts, listed or not listed, are considered discharged when your bk is discharged.

                And as has been stated before, BK is a fresh start. So, it will be ok.

                  Depression and Anxiety

                  I know what you are feeling! I go through these feelings every day...I expect to be filing a personal bankruptcy after filing my business bankruptcy (both Ch 7) once the creditors for my business pull the "personal guarantee" clauses. I'm working with a lawyer but I still don't see all the details on this and get very down due to random events.

                  Anyone out there have words of wisdom related to how to deal with the cascade of a business bankruptcy into a personal bankruptcy? My business was a C Corp and it just didn't make it before I ran out of money. I owe $570k on an SBA loan, $50k on a business line of credit and about $19k on business credit cards....

                    Joymal, please don't open old threads that have been inactive more than a few months. Most of the original posters have been discharged and moved on, and your own questions will get much less attention than if you start a brand new thread of your own.

                    If more than 50% of your debt is from your business, then you aren't held to the Means Test. However, mixing business and personal debts in bankruptcy requires expert and experienced legal advice. Yours is NOT a case you can file on your own without a lawyer.

                    Now is a good time to make free or low cost initial consultation appointments with 3-4 bankrutpcy lawyers in your area. When you make the appointments, make it clear that you have a large amount of business debt in addition to your personal debt. You will learn a great deal about what's possible in your case and what the potential issues (if any) will be.
