    Miss CG is not through with bankruptcy yet.

    Lotta holes in her story, friends - and a GOOD DEAL of potential fraud to boot.

    My money is on the Trustee getting a LOT more than $855.00 per month from Miss CG.

    Fools rush in to trick the trustee with "crafty lawyers" and hidden assets, where angels and honest debtors fear to tread on the intelligence and experience of the Trustee and the United States Bankruptcy Code.

    (I know this is off-topic, but I can't keep it in another second.)

      Well said HH, I agree with you 100%. We have all ended up in an unfortunate situation & some may have crafty laywers but I can say that my attorney is honest & is not trying to cut any loop holes. I was always taught there is nothing more important that honesty.

        I am happy to see he/she has been banned for now. Kinda reminds me of--- what was that girl's name last year- Jenny or somthing like that, planning on filing, but putting everyone down and questioning their decisions.

          Rental Furniture and Foreclosure

          First I have to thank everybody for helping me before my last hours before signing OUR life away. GRANNY thank you for your help!!!!! ALOT OF HELP through IM.

          OK We signed the papers Thursday WE were certified with a number by 5:00pm.

          OK Next THEY callled rental company with furniture payment several times. First they said the fax won't work...then the Manager refuses to take information then they call again and WILL NOT TAKE ANY INFO. so [if I learned anything from this website] THANK GOD I HAVE A GOOD LAWYER!!!!!!!!!!! ANY BODY who HAS to RENT TO OWN and IT IS your LAST CHOICE ...I VERY MUCH UNDERSTAND don't let other people get you down. BUT I BEEN PAYING FOR 1 MONTH SHORT OF A YEAR I was not trying to get anything for free it's just things happen and everybody on this forum that reads this should know. SO the laywer calls and says Rental people are NOT cooperating so he says NOW IF they come NOW I can call the police for trespassing. SO time will tell tomorrow.

          Meanwhile WHEN things seem bad as they get as I was really wanting HELP at the last minute..........I was Surprised LISTEN UP PEOPLE AND LOG ON this website is so very helpful.

          BUT I'm NOT done yet I have to mention it was $1100.00 every month but thanks TO Granny I fought It but not much but I got it lowered to $1020.00

          OK FOR other 1st timers I learned even though 1020 seems like alot it is divided into 52 weeks and the payment comes out JUST a LITTLE bit lower

          YIPPEE IT IS 236.00 Every week


          Anybody know if this will change once the trustee reviews it????
          And once again A BIG THANKS to ALL that helped me argue my case to the lawyer!!!

          By the way got a student loan paper them wanting to withhold our tax refund.....
          THANK GOD WE GOT A LAWYER !!!!! he's going to give them notice!!!!

          OK So What sounds so scary IS but to a limit. I did not realise they break the payment into 52 weeks. So IT MIGHT come out JUST a little bit smaller payment.

          Should I worry Trustee will higher IT? Thanks to all and best of luck if my story helped a least ONE person wanting to sigh in and register!!
          OH and By the way Please do as much reading as I did and get AS much HELP I was on this website for a month BEFORE we EVEN thought ABOUT FILING !!!! AND REGISTERING !!!!
          You might be a viewer like I was BUT it helps to register and I'm just saying it doesn't cost anything BUT you can LEARN ALOT !!!!

            DANM IT .... I was so upset on worring about loseing our house ...I thought LAWYERS were just for money!!!!!

            But Don't knock them till you at lease get the free constation!

                    Each person's Ch 13 payment is based on what their Means Test and Schedules show as their disposable income. You can't directly compare Ch 13 monthly payment amounts because each person's financial situation is so different.

                    Ch 13 payments include montly payments to the Ch 13 trustee for administering the case and usually also include paying the remainder of the Ch 13 lawyer's fee plus secured loans such as cars and repayment of IRS taxes. Anything left over goes to unsecured creditors who file claims.

                      I have started my payments but think there is a mistake

                      I think my attourney made a error in my income. With her budget allowances I would be in the negative. Know I find out adding collision to my car will make my auto insurance go from $79.00 to $215.00 I am not driving a Porshe. I am hoping that since I've not even had my creditor's meeting, maybe I can have my payments fixed. I just made my second payment....this is a frighting process.

                        Your lawyer can easily amend your forms for simple expense changes like this if she does it before your 341 meeting. Contact her immediately on Tuesday after the holiday is over!

                        And you are 100% right - filing Ch 13 is a frightening process. You are tying yourself to a court-mandated repayment plan with very little wiggle room for 3 to 5 long years hoping that no significant decreases in income or increases in expenses happen.

                        Knowing that it's easy to see why only about 30% of Ch 13 filers make it successfully to the end of their plan. Of those that don't make it, mMost end up filing Ch 7 because of unforeseen changes that put them below the median. The rest either have their lawyers amend their plans to reflect the changes or have their Ch 13 dismissed for non-payment.

                        Ch 13 is a tough, long road for sure but when you have income and assets, it's still a heck of a lot better than the unending slide down the debt chute with garnishments and liens that you can't stop for decades to come. At least there's an end in sight instead of an endless black debt hole.

                          I'm hoping to be fine with having wiggle room. My family owns the condo I'm renting. If I couldn't pay, they wouldn't be upset at all. It's just going to be mine one day anyway so they said if you don't pay, you're giving up future equity. When I did the means test online, the expenses they gave you were higher then I would pay each month. When speaking to the attorney on the phone, giving him my income, expenses and creditor amounts, I'll still have over $1500 a month for me. I don't have kids or a hubby so I don't have to feed anyone. I eat mac and cheese and cereal all the time.
                          Should I tell him that so my payments are higher so I can pay more into the plan?

                            No one on this board is going to tell you it's ok to commit bankruptcy fraud, HTG. If your trustee knew that your "rent" on your forms doesn't really have to be paid, your payment would be going up so fast, your head would spin like the girl in The Exorcist.

                            Just because you are able to bend the current bk law to your personal advantage doesn't mean it's not fraud to do so.

                            Frankly sharing this kind of information about your case in a public internet forum is risky. Do you think that we debtors are the only ones who read these boards??? And if you think that the administrator of this forum will protect your identity if subpoena'ed by the bankruptcy court or US Trustee, then you need to have another think on the matter.

                              Ok, I'm confused. I DO pay rent for my condo, I'm just saying, if I miss a payment, it's not the end of the world. This is why I'm saying, should I just tell them that I don't HAVE to pay but I do, so that they will increase my payment? I AM being honest about it. I want to pay what I'm supposed to. I just don't use every expense that they say I should in the Federal standards. I've read on here that many don't and have that extra each month. I want to be fair and pay whatever it is they think I should. I'm not hiding anything. They can take what they want but after doing the means, I see that there is much more left over then there should be. How do I tell the trustee this? Can I tell them that I can pay MORE if my attorney says I can't?

                                I'm the same as Helpthisgirl, but how I read the post was that she is asking how to LET them know she has a lot left over. She isn't trying to scam!
                                I've been in Chapter 13 for 6 months now and have way more left over then I thought I would!
                                My trustee will find out if he asks for tax returns but I heard he didn't bother.
                                It's odd how some are struggling and some are fine with payments.
