TX69, I am so glad you got your payment lowered, every little bit helps.
Living on a 13 budget is HARD, but it can be done. We are here if you need to ask questions, groan, moan, or gripe about anything. If you don't believe that, search out some of my posts. I have even griped about things that were so not bk related and found good advice, comiseration, and just plain concern for me.Chapter 13 filed -8/12/04

If your attorney gives a payment to the court and they accept it, and she has income left over, it's not her problem. Some people I see on this board are bitter because they don't have leftover income, but that's not anyone's fault but theirs and their attorney for not doing the means test properly. Some states are different then others and you can't compare apples to apples. Some people's income also fluctuates like mine. I work on base + commissions and they took the avg. of 6 mths to calculate but now if I want, I'll just sell more or take on side jobs for extra income. If they want to audit me, fine, I'll pay it, but if they don't, thats not my problem.
I sure as hell ain't going out of my way to pay the extra. Let them do the work! They probably figure out, I'll have slow months too where I'm just barely making it. Either way, it's a hell of a lot less then what I was paying!

I just have an added comment about the mortgage being included in the plan. The trustee did not give me a choice on whether or not it will be paid in the plan. On the plus side my payment was never late to the mortgage company and the trustee filed a motion with the bk court that said that the mortgage is current and all defaults cured which if granted will keep the mortgage company tacking on fees and stuff after the bk is over. Also the trustee did not charge the 10% on the house payment or my car payment. I just paid the 10% on the unsecured debts.

I'm tickled pink you can make more money some weeks or months, but there are many of us here that are at the end of our careers, too mature to start in a new field with variable incomes, too much to risk if we don't have that steady pay check that we can count on. We can only put in so many hours a week. To put yourself in our shoes, imagine living the next 5 years on your base pay only...that's what it's like for us.I used to have a life, now I have grandkids.

When I was Ym'ing with TxLady, she told me that her hubby wanted the house payment in the plan. I didn't realize that trustees didn't charge their percentage on the house payment too. Thanks for correcting me on that.I used to have a life, now I have grandkids.

What actually could happen is this: Once the trustee notices that the income is salary + commission they may ask for quarterly reports. In this way they can be assured that all income is being reported accurately. They do this for commission based filers regularly. The paystubs will probably reflect the breakdown and the trustee may want to see what the pay looks like on a regular quarterly basis for the life of the plan.
