    Could this look like Fraud?

    I am starting the process of filing-but this past month I have probably used $400 on a cc......I wasn't thinking and I wasn't sure if I qualified for bankruptcy-I just don't want to be denied.
    Any advice appreciated.

    that may be a no-no....cc company may object...ask your atty if you have one or get a free consult....they usually like at least 2 or 3 months of no use before you file....

      A lot depends on what you bought too. If you paid bills or bought groceries, that's one thing. Some sort of luxury item is a whole different story.

      As Guzzie said, most attnys will want no CC use for at least 90 days prior to filing.

        Worst case, if the c objects, you may have to pay back the $400.

          Well figures I don't know what I was thinking. I paid for a prescription with it, and some other random stuff-no luxury items.
          I am thinking I might just wait another month or two because I transferred 2k in cc debt onto a 0%apr card(till sept 08). Any thoughts on that.

          The problem was that i wasn't sure if Bk was an option for me, but I know it is now, and its not the end of the world.

            that too may be a no no....talk to your atty but your time frame sounds more like a november filing with a feb 08 discharge but still I hope you can file sooner than later...good luck....

              Why is a balance transfer a bad thing? If you are just moving one loan to another place that offers a better rate at that time... it is not like buying something like creating & adding to your bills.

              Or is it because the recent bank with the transfer will be angry since they are stuck with it just prior to BK? I could see that as a problem.

              just wondering.

                  We did a balance transfer about two months before filing. The new creditor was angry and threatened to object (luckily it was only 1500 and they didn't end up objecting). The trustee went after the old creditor and got the money back as it was then considered a preferential payment. So now we are an asset case and will probably take quite some time to close.

                  Honestly none of this was a major problem and most of it was delt with by our lawyer and the trustee. However it has delayed our closing and has given a couple of minor complications and added one more creditor to the mix who really didn't have to be there.

                    Well I think I might just wait and file in Oct or November-I will get all my info ready(paperwork,paystubs etc)and then file sometme in the fall. Thanks for the advice guys!
