    try this online means test to give you an idea if you qualify for a chapter 7 or a chapter 13.

    If you go chapter 13 Richard Kaufman has a point. You employer will probably find out you filed as most districts require you payments to come right out of your check via payroll deduction. If you work for a small company meet with HR and explain that you will be filing. Find out what you can do about travel expenses and let them know about the payroll deductions.

      As one bright spot in the gloom, I also have a company credit card to use for business-related expenses. The card is in my name, although it's through my company, and the bill is mailed monthly to my home. Both my company's name and my name are on the card. My HR rep said she sympathized with my situation but the company had no influence on whether my card stayed active or not because they didn't guarantee payment if I defaulted. I felt the very same panic you are feeling now.

      On our lawyer's advice, I called the cc company (not AmEx) myself and discussed the situation with their collections/bankruptcy manager directly before we filed Ch 13. He checked my record, saw I had always paid on time, and said as long as we DID NOT list the card on our creditors list and they saw no personal charges on the card while our Ch 13 was active, they would keep the card open after we filed.

      It's now 14 months after we filed, my card is still active, and I'm still charging business expenses on it. My next waterloo is going to be the end of this year when I have to renew it. Since I have been VERY careful to put NOTHING on the card but business expenses, I plan on contacting the collections/bk manager for the credit card company again in early November and hope for the best.

        Thanks for the post. I was just thinking about calling AMEX and speaking with someone about it. I will definitelty wait on what my lawyer says if we decide to retain her.

        Now I have to make myself sit down this weekend and complete the means test. A Chapter 7 and keeping the house and leased vehicle would be swell Can't wait to see what it says.

          It sounds like my trustee will want to do a payroll deduction to get his ch 13 payments...your trustee may want to do this also, so your employer, like mine, will find out anyway. I am dreading telling my boss, but she is also in charge of payroll so she is going to find out anyway. Yes, it sux! Sounds like you will be going 13 also...good luck.
