    Rent during bk

    I will probably be filing Bk soon and will surrender my house in the proceedings. I'm trying to rent so I have somewhere to go. I am a little
    concerned about the lease agreements, however, as they all say that if
    I bk then then may just take the place back and I'm out of a place to live.
    So, how did it work for those of you that were renting or did rent prior to bk?

    We rented prior to filing BK.

    If you're showing current on payments on your Credit Reports, you'll probably be OK to apply at large apt complexes that generally require a Credit Check.

    If you try to rent during an Open and Active BK, Landlords know you can add your Lease with them and Discharge your debt. Whereas, if you rent prior to filing, you won't have that hassle. AND, you can cover your Landlord by listing your lease in Schedule G. Executory Contracts and Unexpired Leases.

      Filing Bk didn't have any effective on my rent. But I have been renting the same place for 6 years when I filed. Try to get a place before you file and the BK hits your credit reports, you should be fine! Kind of like buying a car before you file - before the dealer hits you with a higher interest rate.

        If your user name is "phoenix" because you live in Phoenix, I do too. I actually had to move out my current rental because my landlord freaked out and pretty put us in a situation that we had to move. I found a place after filing with no problems. The home is bigger, better and cheaper then the home we moved from. We found a home that is 3400 sq feet for only $1300 on a very large lot, park directly in our backyard and we have first bids on purchase when we are ready. No credit check. There are a lot of home like this in Phoenix.
