    Another Job Question

Just a job question for anyone who has any answers. I have read that if you are going to change jobs to increase your income you should wait until after your 341. I am filing a Chapter 7 on my own and my 341 is June 26.

I went for a 2nd job interview last week and I am thinking I might hear something by the end of this week. This job would most likely pay me a little less than what I am making now but the hours are very flexible which would allow me to be home with our baby girl more. If they were to offer me this job do you see any way I can take it or should I not rock the boat? Bad timing with the 341 at the end of the month I guess. I don't want to do anything to mess up my situation but at the same time this would be a perfect opportunity. If I were able to work out my start date until after the 341 (assuming I get it) would that help.

    Any thoughts/advice appreciated. Thanks.

It's always been the advice of lawyers to wait until after the 341 to make any changes in your job situation whether it's for lesser or more pay, unless something unforseen occurs of course. You will be asked by the trustee at the 341 if there has been any changes in your income, etc. So be prepared to answer those questions and it's possible then you may have to amend your schedules. Personally, I wouldn't do anything, not even something small unless it could not be helped to interfere with my bankruptcy.

Accepting the job and starting the job are two different things. Human Resources departments typically move at a glacial pace, so it could be weeks before you get a formal job offer. Until you actually start the job and receive a paycheck, you can be honest at your 341 and say no if you are asked about a change in income since filing (the reason laywers suggest not taking a new job before the 341). (And in this case, since the new job won't pay you more than your current job, it won't matter anyway.)
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

Until you start that first day and fill out all the first day paperwork at HR any job oportunity is just a possiblity. Anything can happen between the interview and the first day of work or even between the job offer and that first day. Therefor you can honestly answer that there has been no change in your income and no expected change if asked at the 341. Plus as it is less money it really won't make a difference at all.
        Filed: 10/26/2006
        Discharged: 03/05/2007
Closed: 5/19/2008 - Asset case due to balance transfer and income tax refund

          Ditto's to what others said.

Plus, at a little less pay, Gross, you might wind up with nearly the same amount Net. Factor in differences for taxes, benefits, and such, your take home may be nearly identical.

Now if you were gonna be earning significantly more, that would be a different story.
