I filed Chapter 7 in 2003. I am in debt again. I have four Rentals that are in Forclosure. My Primary mortage is 2 months behind and I am on my way to having a nervous break down. Can anyone tell me what options I have. Thank you.

You might be able to file Ch 13 to help alleviate some of your budget issues. But like CMIYC said, you cannot file Ch 7 again for 8 years.

Just curious, when you filed before did you go through with the bankruptcy, I mean it wasn't dismissed or anything was it.
If it went the normal route and was closed then you can't file a chapter 7 again for 8 years.
If the previous filing of bankruptcy had been dismissed though I think you are allowed to file again.

You can file for a 13 now but not a 7. We unfortunately had to file a 13 because we filed a 7 in 2000. It's so pathetic , we have never had anything but credit cards and loans, we have never had property involved. But we make about 40,000 below the median income for our state and it's just taken it's toll on us. It's not at all that we spent on lavish things at all it's just we never made enough to keep up with our families needs , so it was robbing Peter to pay Paul all the time and we got so overwhelmed and I tried the Debt Settlement route but the lawsuits came into play and I just couldn't take it anymore so we filed a second time. We are dead set against having more than 1 card from now on, we are 40 and 33 yrs old and have nothing to show for it, it totally sucks. We have to look at ways to make it work and not over exceed our limits anymore. My hub is working his way up to a decent salary at work and I have gotten a good job and I want to start a business next year that I just do on the side seasonally now and have very good remarks so I want to expand on it. So after we are out of this 13, I am hoping that we will finially get our feet planted firmly on the ground and beable to make a good life for ourselves. We have always worked hard.

You should be able to file chapter 13 but you can not file chapter 7 again for a few more yearsSometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.
