    Question on changing attorneys

    I haven't been happy with the attorney I originally retained who "guided" me into prepping for Chapter 13. I haven't filed and probably won't for another couple of months. I'd only had the initial consult plus two simple emails replied to by my attorney. After consulting a different firm yesterday (wasn't aware that I shouldn't do that while another is on retainer but I wanted a second legal opinion) I've decided to close my case with the original attorney.

    I called their office when I got back to work yesterday and told them I was closing my case, drafted a letter stating the same thing, and walked the letter and my "red folder" of info back over to them. They said they'd refund my money in about two weeks if there was any left over after itemizing work done on my case.

    Shortly after dropping off the paperwork, I got an email from the attorney:

    "I received your red folder and msg that you want to jump ship; what gives?"

    Do I even need to answer him? Or will they charge me for that, too? Suggestions? I just feel so much happier to be rid of that firm.

    02/15/08 - Case closed

    DO NOT go with a firm that you are not comfortable with. I did it twice and will regret it for the next 4 and one half years. And it is costing me several thousand extra for attorney fees and shoddy work on his part.

    Not sure if you even need to reply to him, but if you do, keep it simple, tell him you've decided to take another avenue. You don't have to expand on what the other avenue is.

      Maybe he is a junior attorney? .. now getting red-faced from his boss that you fired him too soon !?

        Respond to the attny with some sort of BS that's nice but gets you off the hook.

        Maybe say you've had a chance to consider the gravity of filing Ch 13. You've simply reconsidered and decided not to move forward in that direction. Thank him for his time and assistance in your decision making process.

        Leaves you on good footing with him. Saves face for him with his firm. And you're FREE!!

          SinkingFast - you rock! I just cut and pasted what you said - modifying it, of course - and emailed it over to him. Now just have to wait and see if I can get some of my money back from them.
