    Questions?

    I have a bank account that is associated with credit so I don't use it wanted to close it but my paralegal said don't, they will close it . In the mean time I have to pay to keep the account . Why would he tell me not to close it? Second question my ebay fees went onto a credit card that had zero balance now 213 I was just gonna pay it and not mention it , however this credit card was not listed for bankruptcy because it did have a zero balance . It was used for fees that I just coulnd't pay in time before ebay charged my card . I sell stuff to try and make income which is counted as income and known in my bankruptcy paper work . I am just worried the card was used so close to filing . Should I be concerened, I plan to just pay it in the amount of 213.

    Because closing an account close to filing will raise the suspicion of the trustee and can cause him/her look at your case more closely. That's something to avoid, even when everything is on the up and up.

    Technically you didn't tell the truth on your filing since you said the balance on that cc was zero when you filed and it wasn't. All major credit cards share information such as who has filed bk with each other through a mutual database, so this cc will very likely find out you filed. Chances are nothing will happen - just keep a low profile Since it's less than $600, it isn't likely to be considered a preferential payment - still, please ask your lawyer about this. If you have a difficult trustee, then you don't want to be doing anything to get on his/her radar.

      You have to disclose all bank accts closed within 1 year prior to filing BK. And Lrprn is right,........ If you close the acct now, you'll send up a red flag for the Trustee.

      Just sit tight on that bank acct for a while longer and deal with the fees. Better than waving a cape in front of the bull.

        so we have not techniquely filed yet paralegal is working the paperwork .

        So i will call and tell him then. Thanks for the info.

          actullay it was stated not to list cards with a zero balance .

          So the card was not listed. If I pay before we are filed is that ok

            You have to disclose payments that total $600 or more to Creditors within 90 days of filing. This amount is well below the $600, and you disclosed eBay in your BK paperwork. This payment could well be considered "Normal course of Business" just like your gas and electric or water bill is.

            Best to be safe rather than sorry, tho. Ask your attny just to be sure.

              I would pay it and forget about it, but keep it open. It may survive the BK and remain an open active account. If its zero at filing and under 600 there is nothing to worry about. period.
