    Can we do anything about this

    Chase H F is my mortgage company. I included 4 months arrears in my plan, which includes escrow payments in the amount of 341.00

    In January, I replaced my homeowners insurance with a policy that is almost half of the previous policy. I received a letter on 04/26 that indicates that I have 681.00 coming as a refund of escrow, unless of course, I am in arrears, in which case they will return that money to escrow (in essence, sit on it until I am caught up).

    So what I am thinking is that of the 4772.00 that I am paying through my plan 1364.00 is for escrow that won't be needed and would eventually be refunded to me, along with the 681.00 they are holding. Can I force Chase to amend their claim to reduce the unnecessary escrow payments?

    You can have your lawyer contact them to request a review of what is owed and to change their claim, but it's likely that Chase will try to wait until your Ch 13 case is discharged. Then Chase will review what they have been paid by the trustee and make an accounting of what is owed to who.

    This is how Chase insisted on handling our request to have their lawyer's fee for filing the objection to our case that was thrown out in Feb by the court removed from our mortgage accounting on the Chase side. (Yes, I confirmed a few days ago that it's still there, although it's nowhere to be seen from our 'informational statement'....really makes me mad!) Chase refused to do anything until we are discharged. We are expecting that "fee" to grow as it remains unpaid throughout our Ch 13, but our lawyer is ready to take Chase on again at the end if they try to pull the same shenanigans they did when we filed.

    We are watching Chase very closely....glad to see you are doing the same.
