    What do you tell your (nice) creditors?

    Or do you just not return their phone calls? I keep getting calls from the nicest woman from our previous bank (we changed banks when we made the decision to file because we also have four loans through them, including our second mortgage). She is trying to help and I have been leading her on, telling her I'm trying to figure things out when I know full well we are in the process of preparing the bankruptcy paperwork. I just haven't had the guts to tell her. Should I tell her, or just keep ignoring the phone calls?

    Please help!

    I think you need to understand there is nothing personal about it. That nice lady from the bank will get her salary regardless of what you do.

      If you default, the bank makes a business decision to try and get their money back.

      When you can't pay, you make a business decision to file BK.

      That's all this is. A business decision.

      If you're getting close to filing, it may not hurt one bit to tell her. Maybe you live in a smaller community and don't want the Lady at the bank discussing your business with every body and his brother. If you don't tell her, it won't matter either.

      One way or the other, this is just business.

        I would just ignore the phone calls and concentrate on your "business plan!" When you have at least retained you lawyer (if you are going to have one) than give the creditors his/her number to call a million times a day!

          You really have to step back from things and keep the normal emotions at bay in situations like this. You can't be selective in choosing to include or not include creditors, so they should all get the same message from you...of course, how you deliver it to one versus another can vary! Nice to some, stern to others.

            I'll go you one step further.

            Their nice act is just the tactic they've chosen to apply to your case. Your response is proof that it works.
            Their goal is to apply whatever tactic they can to you to get you to pay them instead of others.

            For some people, they'll pay the nice ones first.
            For other people, they'll pay the mean ones to make them stop.

              I wouldn't tell the nice lady at the bank anything at all.

              Stop talking to her.

              When you finally do file BK, her employer will get an official written notice that you filed BK.

              Let that be the only communication between you and your creditors... both nice and mean ones alike.
              The world's simplest C & D Letter:
              "I demand that you cease and desist from any communication with me."
              Notice that I never actually mention or acknowledge the debt in my letter.

                I would also be careful about talking to creditors when you know you are going to file especially "nice" ladies. Remember her job is to do or say whatever it takes to get the money from you, thats her job. Don't let her cause you to slip up and say anything to her that they could use against you to object to your discharge.
