    if I make one payment & skip next 2 then make another payment...

    basically, would this prevent them from sending warnings and lawsuit if:



    i pay one month, skip two months, then pay the next month.


    i need to drag my father's bankruptcy filing: would this method prevent my lender from sending accerlation warnings and such?

    A default is a default, once you miss a payment, you are in default. Thus, there is no reason to throw good money after bad. Regarding lawsuits, many many months, and sometimes years will pass before you get sued, so that is not really an issue.

      It just delays the inevitable !!! Thats basically what I did with my creditors, DELAY THEM ! Get their hopes up high that "Hey, they made a payment!" I never got any phone calls .. they only went as far as sending me friendly reminder letters .. than I would send a payment .. they shut up for one month .. than Id skip a month .. back and forth .. finally I filed ! No more letters and never a phone call.

        If we're talking about the Chase "Mortgage" Loan here, theres a couple of things to consider.

        New York is almost always a Judicial Foreclosure State. Something to do with being absolutely positively certain the Lender get a free and clear Title to the property. The only way it wouldn't be a Judicial Foreclosure is if you have a "Right to Sale" clause in your loan documents.

        So let's say your "mortgage" is a typical NY State mortgage,......... It's gonna take Chase a year, maybe 15-18 months to drag this whole process thru the system. You were hoping for a few more months. A Judicial Foreclosure should give you plenty of time.
