    getting sued need advice

    Im about 70 to 80k in debt on my cc,I stopped paying on 5 of my cards(have 10)been paying on others,I just got a summons, being sued by Portfoliio recovery Assoicates for HSBC. i had read somewhere that i can file something to delay this,im going to start to look for a lawyer this week but i know i read a thread about delaying the judgement.Also my court date is 4/24 i was wondering if i dont show they win the case how long before wage garnishment ,liens on my condo and grabbing the money out of my accounts start.

    You need a lawyer quick...you can not miss your court date

        You needed to file an answer to the Creditor's claim prior to the Court date to prolong the process and buy you time. Since you didn't show at Court, they probably got a Default Judgement against you. It's an easy move, now, to get a Wage Garnishment Order, or a Banking Institution Garnishment Order, or file a Lien on whatever property you do own.

        I don't know if there's much of anything you can do right now to slow the process. Except file BK before the Garnishment takes effect.

            Thanks. Year and a half is a long time. I stopped paying my cards recently and i am trying to get a sense of when creditors sue.

              This is just from personal experience, we got papers saying we were being sued last summer. When we got the papers it was already 3 days past the court date. Although we called and said we JUST got the notice, they still went ahead with the garnishments. I do believe it was one or two paychecks later that they had started the garnishment.

              You need to find a lawyer soon. And file as quickly as you can so at least if the garnishment does start it won't stay on for too long.

                Why would you pay some credit cards,

                when you stopped paying others? You ruined your credit, and are indicating to the cards in default that you have money to pay some credit cards but have decided not to pay THEIRS- I'm sure that's the reason for the suit.

                  wow i just got a call from another attorney, there going to sue to,i told him im looking for a attorney and going to file bk so there giving me a week,anyone known of a good bk lawyer in Connecticut?I just contacted legalhelpers anyone use them?

                    I read the date wrong!! I thought, for some reason, your Court Date had already passed.

                    Several people here have used Legal Helpers. With mixed results. Some people have had very good success with them. Others, not so great. The attny was never available to answer questions. Some were slow to file proper responses and such. About the same result as many posters here have had going with individual attnys.

                    I'd suggest you Schedule at least 3 or 4 Consults with different BK attnys. You can even try to get a Trustee or a retired Trustee.

                    If you live where there's only a couple of Trustees, don't visit with both of them. You'll taint your Trustee pool and the Court will have to bring in someone from outside to hear your case.

                        I am going to call Neil Crane tommorrow, i ckecked his website and he has a office about 10 miles from me,im also going to call one of those trustees and see about one of them, i have about 3 in the same area,i was wondering how much he charged you,and did you own your home?

                          Be sure to ask Mr Crane this, because it may vary based on your state.
                          But if they attach the lien on the condo, it could be stuck there regardless of bankruptcy.
                          You may be in a race to court.

                              I stopped paying my Discover card in August 2006 and they served me papers in March 2007. Some don't take that long. I filed before they could garnish anything, though.
