    Adverserial proceedings happen -not frequently.
    Here's a recent one from another board.
    What is the name of your state? ca. One of my creditors has filed an objection to the discharge of the money/cash advance they credited me on a Visa and the court has set up and adversary proceeding. Is there a form I must use to answer their reply or do I just put it in a letter? Also, is this...


    There is another poster on the free advice site reporting AMEX has filed an adverserial action.

    My point in this thread is just refuting the notion that the proper way to defend one of these is to attack the credit grantors policies and procedures in extending the credit. That just has no hope of flying.

      That site does not detail a successful oposition by a creditor.

      Only that they object and are tring to work on an agreement. The point is simply that there are all kinds of differently worded questions in here about the possibility of a credit card objecting- and it's not common that it happens, and when it does there are plenty of ways to make it difficult for them to convince an actual court to discharge their claim. Of all the sites I've been watching it appears very highly unlikely. Then again? What are your odds of winning the Powerball? Not great- but SOMEONE has to win~

        That case sounds like a Pro Se filer with an offer on the table from the Creditor to Settle, BUT the Creditor had indeed filed the necessary Adversary paperwork just in case.

        Note,.......... A date has already been set "at the "summons & notice of status confrence" that is on 3/15." The Debtor/Filer has until then to reach a satisfactory agreement with the Creditor or the games begin. Evidently this person does not know the correct way to respond to AMEX's demand, formally.
