We have made most of our own calls on this.
The only thing that the lawyer was part of was proving that we did send a reaffirmation out that CapOne signed/agreed to, which CapOne came out of the gate denying yesterday. When the lawyer made their inquiries they were told that "(CapOne) never recieved a dime from us" after our filing so there was nothing more they could do for us since we have already been discharged from BK.
Remember the bankruptcy lawyer is there to handle BK related items only, what is going on now would require a completely different type of lawyer who would need to be paid by the hour/minute.
Also, as of today, any further calls from us to CapOne regarding our account gets us "hung up" on immediately because according to them our account has been closed and we have no recourse. On top of that, other than an address, we have NO contact information for "Ascention Capital". And looking them up on the internet gives me no clue as to who they are and why we were told to send them the money for our vehicle while "CapOne" looks to have been withholding our account information from us.
I think the hardest thing we are having to deal with right now is having certain family members side with the "credit company" on this convinced that we must have not been paying for the vehicle because "corporations" don't treat people who pay their bills on time like this. When other than the refused payment at the end of August, we have NEVER been delinquint on this specific account. I've been in financial trouble a few times in my past for various reasons and was able to pull myself out of it by my own bootstraps, so I know from past experience where to priortize my payments. Also we were down to 18 payments left on the vehicle. Why in the world would we want to screw "that" up after making a clean break?
Things might be looking up, I have a friend who has agreed to let me purchase an older vehicle from him by making payments. Just have to work out the details.
