    live in girlfreind and bk

    im going to get laid off next week,im about 70k in debt on my cc's, im going to collect 1620.00 a month on unemployment, my morgage 2nd morgage and basic living expences add up to about 1800.00 a month.my girlfreind lives with me and helps out with expences. how would a trustee deal with the fact i dont make enough money without her help, i dont want to lose my condo.I live in ct and they allow 75,000.00 in equity so im safe there but would a trustee allow a girlfreind or roomate for that matter help out as long as payments are current thanks for any help

    Others will chime in here, but I'm assuming you will include her income when you file. I'm not familiar with Bk and assets.

      I have a similar situation just reversed with my boyfriend. However, if you file and want to use your girlfriend's income, it most likely will put you into a ch. 13. I almost went that way, but then took my bf out of the picture as his job situation switched and I would have been up the creek without a paddle as I no longer had his income to depend upon. If you are single & it will be your bankruptcy, best thing, in my opinion, is to do it on your own with your own monetary figures. I've really never understood the whole logic of doing the 13 (I don't understand the other factors of it most likely) because it all goes on your record (I think?) just like the 7. But in the 13, any disposable income goes to the trustee....I think others who are wiser on this board can give some good advice on this, too!

        If you don't make enough yourself to support a Ch 13 monthly payment that would equal at least what your creditors would get in a Ch 7, then you can't file Ch 13. How much equity do you have in your condo? Which state do you live in? Have you lived there at least two years? Are your mortgage payments current?

        Sounds like it's time for you to make 3-4 appointments with experienced bankruptcy lawyers - most have free half hour to hour consultations.           With your income alone you might be able to file Chapter 7 and discharge all your debt.A done deal.If you include your girlfriends income that becomes a whole different ball game.
          I say leave her income and contributions to your expenses out of it.She can just be considered a 'roommate'.
          It's best to consult with a few attorneys and get some legal advice.
