    I did something very stupid

    I knew I was in financial trouble, and there was a chance I may have to file bk. So before I closed all of my accounts, I bought a couple of major appliances....a stove and a dishwasher. Both of mine were not working.

    That's why the attorney told me to wait 6 months before filing because they can check my cc statements for the last 6 months.
    Now I am worried about fraud.

    Is there anyway to claim that credit card but pay for the stove and dishwasher? I never made payments on that account after I bought the stuff. I just didn't know how serious the ramifications could/would be.

    What do I do now????? The more I read, the worse this whole situation is. I am a nervous wreck. What a way to spend Christmas Day. I'm obsessing over this whole thing.

    1. This kind of fraud is not the same as fraud as we commonly know. You wouldn't be prosecuted for it. You are not going to jail over this. It does mean you will have to pay back the money, if the creditor successfully prove its case.

    2. To make it harder for the CC to deny your discharge, you need to wait 90 days. In your case, your lawyer adviced 6 months. So be it. Then you should be fine.

    3. Not making any payment at all, seems to make the whole thing stink. Should have made a couple of minimum payments, as a proof of good faith.

      blah, don't worry about it... wait the 6 months your attorney is advising and stop worrying. The WORST that would happen is that the cost of the appliances would not be discharged and you'd still owe it.... the rest of the credit card balances would still be discharged.

        I bought a couple of kitchen appliances on our Sears charge in August, '05. Made payments thru December, '05. Filed in September, '06. Not one peep from Sears.

        Your attny advised waiting 6 months to file. Follow your attny's advice.

        Keep this in perspective.

        How big is the Creditor?? To a Chase, a Citi, a BoA, your debt level is VERY insignificant. A good rule of thumb,.......... Generally speaking, it has to be over $2K to be worth their legal fees to come after you.

          It was my Circuit City card, but I bought the appliances from Sears. I think it's a Chase card...not sure at the moment. I think the total debt on this account is right at 10K

          By the way, SinkingFast, I am now beginning to appreciate your joy (to put it mildly) over your discharge. A big Congratulations!!
