    Met With Second Attny.

We had already met with one attny and kind of liked her but so many questions came out unanswered for us. We never felt compelled to "move" on the situation. I felt very stuck. We liked her but also felt she was disorganized and unclear about some things. My mom talked us into calling her old BK attny who did a steller job for them. She was retiring and gave us a name of the person she said was the best in the area. I did some research and apparantly she is well-respected by her peers, was a trustee for 10 years and just knows her stuff back and fourth. So, we made the appoinment.

It was organized from the beginning. The paperwork was very thorough and clear as to what she needed in the consult. My mom went with us so she could take some notes for me (we are moving in with them b/c I was just hospitalized for bi-polar) and my mom wanted to hear what she had to say. They showed us a video about the differrent chapters of BK. Then we spoke with her. She was so professional and really knew her stuff. She said that we were clearly a chapter 7 and that she could handle any presumption of abuse associated with the 6 months back income b/c I no longer work and our expenses would out weigh our income. She also said that in chapter 7, student loans are allowed in the means test budget b/c you are required to pay them, period. She said that courts elsewhere may say no, but around here it's allowed. She also told us about selling our house (it's under the foreclosure in Texas thread in the foreclosure section.) She was a bit pricey, but not unreasonable. We retained her and she said to refer all creditors to her office every time anyone called. We met everyone in her office. They all told us thier specific job. We got a packet they went through with us and gave us several e-mail addresses and phone numbers we could call with questions.

    We were very impressed.

If your case is a bit complicated, I would pay up and go with the second attorney, just to be sure that the whole thing is uneventful.
