    Question about AMEX cards

    Hello:

    I will most likely be filing BK7 next month after the holidays as i have about 70K in cc debt, which i am ashamed of.

    My question is about Amex cards...i have 2 with about 12K on them together. Is Amex harder to deal with in terms of objecting to dismissing my debt compared to the others like visa, discover, or are they all the same?

    I am just afriad that when i file, one of the companies will foul things up with an objection.

    We filed Ch 13 listing multiple credit cards, including two AMEX cards with greater amounts on them than yours. We had no objections from AMEX, and they did notify the court they wanted to be in our payback. Within weeks after we filed, AMEX turned both of our cc accounts over to a third party company to administer the payments. From what I've read elsewhere, this is very typical, so I wouldn't waste time worrying about an objection unless you've done something before filing to deserve one.

    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      Creditors have to have a reason to object...no major credit card company is more or less likely to object.

      The main reasons for objections to discharge from creditors are if you have purchases that fall within the 70/90 day period (when the court presumes the purchases are fraudulent) (90 days from filing for non-necessary items, and 70 days for cash advances). However, even outside that 70/90 day presumption period, most creditors will object to cash advances, major purchases, and balance transfers that were made within 6-8 (or less) of you filing BK.

        We owed $22k to Amex on ONE card... no objection (at least not YET). But all of our charges were at least a year old.... and there were no cash advances.

        As long as you have nothing "suspicious" on your account, I'd say you were fine.
