    Collection Agency Calling After Ch. 13 confirmed!!!

    I received a message at work today to call an 800 number . . . so I call back and the person on the other end says, "Hi, is this ______ (my name)" I say yes, it is, who is this please? He tells me he is with a collection agency for a jewelry store with whom I had an account and he is calling regarding the amount due. He did not tell me his name or the name of his company, only that it was a collection agency for the jeweler. I tell him that I filed BK in May. I then proceed to give him the name and phone number for my attorney. I then tell him, "that's all you should need . . . " he says he didn't get the number, I repeat it, then he asks for the attorney's name again, I tell him, spell it for him even. I again tell him, rudely and abruptly, that's all you should need, call my attorney, and I hang up.

    Two seconds later, my phone rings (at work!) and it's him . . .he says "don't ever talk to me that way!" I was shocked that he would call back. I was like, "WHAT???" and he says, it again, "don't ever talk to me that way" I hung up on him.

    A few minutes go by and I think, I should call and get his name/supervisor's name cause that just doesn't seem right to me. So I call, another guy answers and I ask for the supervisor. He says he is the supervisor. I got his name. I tell him what happened and he seemed nice, telling me that they didn't have any notice of my BK, that's why they called today . . . he was going to talk to the person I talked to before.

    So then I start to think that maybe I should mess with these people a little and bug them like they bug me, plus, I wanted to know the NAME of the company. I call again and someone answers, not identifying themselves or the company. So I hung up and called again . . .same response. I did this 8 or 9 times in a row, every time, except for once, the person answering failed to identify themselves and the company.

    Then, the person I spoke with originally calls ME again . . tells me they know I've been calling, not to call anymore or they will call the local authorities and report me for harassment.

    I call back and talk to the supervisor guy again who again tries to tell me that they only called me because they had no information re: BK. I said now I'm calling to get the NAME of your company so I can file a report for your unlawful collection practice tactics. He would not give me the name and insisted I must already know it since I've called there so much today. I told him, no one identifies the name of the company when people call. He proceeded to argue with me, which got me even madder, and tells me the calls were monitored, I was rude to his employee and if I call there again they will call the authorities.

    Sorry this is so long, but I just wondered if their practices are fair? I know I should probably not have escalated the situation as much as I did, but I get really p-o'd when people like this call me at work. And, I can't believe they don't identify themselves when the call is returned as requested. And I'm curious to know what exactly they think the "local authorities" would do in response to their call that I was harassing them?

    Did you try googling or doing a reverse lookup of the phone number? I would.

      Technically, what they did was a violation of the Automatic Stay protection. But, it does happen. Many times, the original Creditor does not notify the Collection Agency that the acct has been included in BK.

      We got one of those types of calls right after we'd filed. The people didn't identify themselves but wanted to talk to Hubby. Caller ID showed them as Unknown Caller.

      I did what Kam suggested and Googled for a Reverse Phone Search website. I found out who they were and what their company was. The website said they were a Law Firm.

      Then, I did what you did. I called them back. Told them that we'd been called from that number. Asked what they wanted. That's when I was told that they were a Law Firm that had been retained by Chase to contact us regarding an acct we had with Chase.

      When I told the guy we'd filed BK, he got quiet. The tone in his voice went from business like to very course sounding. He asked for our attny's name, contact info, and BK case #. Didn't even bother to say "Thank You", "Have a nice day", or "Goodbye". He just hung up after getting all the info.

        I just tell any caller that if they don't identify themselves, then I wouldn't talk to them. lol That will solve the problem.

          Also, just so you know, you are calling a line that is specifically for debtors calling in (or as they call it, the "dead-beat" line). That is why no one is identifying themselves. Which, incidently, is a violation of the FDCPA.

            I kept telling them I was calling to get the name of the company so I could file a complaint with my State agency that handles consumer complaints. I purposely called back so many times just to see if ANYONE identifies themselves or the company . . . most didn't. I am going to try to find out the actual name of the company so that I can follow through and lodge a complaint . . . not that it will do any good, I'm sure!!

            Thanks for your responses. I'm almost wishing they would call me again. I was pretty rude and obnoxious to them, but I really don't give a darn and my final comment to the last person I spoke with was "F off!" I haven't heard from the "local authorities" about their complaint that I harassed them. LOL

              Does anyone know what the best Reverse Phone Search website is? I've tried this method with very limited success in trying to find out who called me. Some of the sites even expect to get paid before they will reveal the information they may or may not have about the phone number, which I think is outrageous.

                I'd like to know what website you used too, because the only ones I can find that do reverse searches cost money. Did you go ahead and pay for the service or was it free. If it was free, please post the link.
