I would've worn it to the 341 ...WITH THE TAG STILL HANGIN' ON IT.....HAHAHAHA~ Not really...I plan to dress very conservative....not that I have anything special anyway~
I've cut back on clothing a lot in the last few years....my husband is actually shocked that I have downed my closet intake over the last few years...LOL
now if I could just quit buying those shoes......
LOL well, won't be doing that anymore either.........for sure...not with 2300. starin' at me monthly....

We about CROAKED when she showed us what our payments would probably be.....
          $2300.00 a month for 60 months...can you believe it???????
That's MORE than the debt to pay back.... a 100% + payback....
one of the cars would be included in the Chap 13...
          We net 74K yearly
Our CC debt is 96K ...
cars about 39K left on notes total(2 cars)
mortgage 883.00 monthly (includes taxes/ins) both cars and mort. are current
          1 dependant ....high school
they say our disposable income is about 2300.00 a month....
this is unbelievable.........I have BEEN paying this much a month on them, and that's why I am doing BK...because I CAN'T do it anymore....
Attorney is going to "tweek" the numbers some....
          State is OKLAHOMA~
          Anyone got any ideas????????
May I suggest you make an app't with a few other attorneys and get their input on your situation? That sounds really excessive to me.Now I'm not a lawyer and don't know that much about Chapter 13 but it still sounds excessive to me.
Good Luck and let us know how it goes.

            Yes, Donna~
We are probably going to do that....even though I have already paid her the retainer fee and file fee.....I just think something sounds wrong, but I could be wrong myself.....
I originally went by myself (husband was out of town) to a guy, and he told me that looking at what I had brought to him....a piece of paper with some figures on it 96K income 2 vehicles we still owe on etc.... he said it looked to him that we'd only owe about 30K back~ but my husband seemed to think that was totally unreasonable.....so we went together to see this woman attorney, he seemed to like her, and she was up front about having to pay back more than that, so naturally she seemed more in his mind to be the one we should use..... but, now he is not so sure.....I want to go back to the original man that I saw by myself, with my hubby ~ I know we will probably have to pay him a fee, since I have already seen him, but it would be worth it I think, and now so does my hubby~ I am waiting on the female attorney to get back with me and see what she refigures, but I won't wait too long, as I am ready to get this show on the road....I am updating the stuff that she gave to me. I made double copies of everything, so I can show him what her figures were....
Not sure really how he will respond if he even accepts us coming in after he finds out we've already been to her.....don't know if he'll try and BS us.....
but I think it might be worth a try anyway~ I suppose being out 250.00 more $'s will be worth to see what he says~ We don't have very many BK attorney's here where I live, in fact, have to go 35 miles to see either one of them......plus 75 miles to any other ones we might be interested in...but it's not impossible...worth it when you're looking at 60 months...'eh??!!!

              From 3100 to 2300

If what you were paying outside a Bk compared to what you might be paying while in a Bk, thats not so bad (I guess), and at least you are protected from the courts, as far as the automatic stay, judgements, liens etc. Still .. Whewww .. it definitely make me want to quit working (for awhile).

okay here's the latest that I have found out~

Well....today, I emailed the first attorney that I originally spoke with.
I told him that we were unhappy with the way the "female" attorney is handling our stuff....and we were considering dumping her....I did write it a little nicer......LOL~ told him that I didn't want to do anything unethical, but we are very concerned about the payment schedule that she has drawn up.

So.....................after luch his secretary called me on my cell phone~ she told me that "male" attorney would see us if we so desired, but we would have to take some steps to terminate our services with "female attorney" ....she asked me "who the attorney was"...I told her and she says..." REALLY??? She is a GOOD attorney....We send people her way all of the time when we can't take them, are you sure it's not just a misunderstanding, because she really is very accurate"...............I about weenkied my pants...couldn't believe what she was saying.....
she said " well the numbers that she gave you are probably right, and if they are, all that's going to happen here is that we would tell you the same thing..." I was shocked~

So....................now I have a call in to another attorney and will speak to him on Monday....aa06 gave me a link to follow and possibly find another qualified attorney, so I did that the other night and this guy is going to talk with me on Monday~
EXHAUSTED~ that all I can say~ it is very depressing!!!!!

No one is going to badmouth a fellow attorney. Do yourself a favor and go start interviewing prospective attorneys.

                    keep your head up

                    Hey,

One thing that I have found on this site that is universal, we are all fretting about the worst case scenerio and it usually does not happen. This site is the only thing that keeps me from the edge and gives me hope. I wish you lots of luck. Two more weeks till our 341!!!!

I don't think you are naive. (Don't worry about spelling--we all knew exactly what you meant.) But it sounds like you are trying to talk to two attorneys in the same office and I don't think they will bad mouth each other in one office.

You've paid this lawyer person enough money that you should request a meeting to sit down and have her explain everything (line-by-line, if necessary). I assume this figure sounds totally out of whack with your preliminary conversations with this lawyer--ask why it changed.

I'm not sure whether you or your husband is better with this type of paperwork (who does the income tax?), but it would be best if you got a copy of the papers, review them together (get the NOLO book to see line by line instructions), write down questions, and then go for a review with this lawyer. You might also want to try downloading the demo at bestcase.com to input your info and see if the plan is coming out the same.

the two of these attorney's are not in the same office....in fact female attorney office in okla city......she comes to a small town 35 miles from where I live once a week for people who live in this area....
Male attorney lives and works in the small town 35 miles from me, and they have seperate offices on different sides of the town......

She did go over the schedule with us, but there just seemed to be inaccuracies.....my husband actually found some while there with her, and pointed them out...he is a good "numbers" person...
she never promised us a rose garden.....but we were expecting about half of what she showed us....even she said that we would be somewhere around 1000.00 month x 60 originally

We have an accountant that does our tax stuff, so we just put everything down on paper....accountant does the number punching.....I'm self employed.....

I believe I will get that book anonymuse~ the NOLO book...is that what it's called specifically???? "The NOLO book" ... I will look for it this weekend.....
                          thanks anonymuse!!!!!!!!!!!!!!!!!!!

We're kind of a small town, CAB. And trust me,.......... We made the Circuit.

BK attnys are generally a close knit bunch. I'd think if that small town guy had problems with the "Lady" attny picking up the slack you'd know it.

Porky Pig I told you about,......... Every other attny said "He's a good attny." But you could see or hear or feel the "BUT" hanging in their voice, their eyes, their look, their body posture, the air in the room. LOLOL

Your first guy giving you numbers in the Consult,........ He was shooting from the hip. Untelling what your actual plan payment woulda been with him.

Definitely talk to another attny and see what they have to say.

Find out how bankruptcy works, what bankruptcy can do, the differences between Chapter 7 and Chapter 13 bankruptcy, and if you should declare bankruptcy.
