    Credit Card still open

    Hi! I’m Tina. I had my 341 meeting on 10/23. Anxiously waiting to discharge. All my accounts in my credit are showing closed due to ch 7 Bankruptcy except my student loans and a capital one credit card with a balance of $300. I am wondering why it has not closed out yet? Might it possibly stay open? If so should I pay it off?​

    Student loans are not discharged in bankruptcy. The only exception to that rule is if the debtor asked the court to specifically discharge them due to a true hardship. The hardship is typically a high hurdle and barrier to getting them discharged. Student loans would go into forbearance while the bankruptcy is active.

    Sometimes a creditor may miss notice and a card may not be updated. It happens. Do not use that card. You want that $300 to be discharged in the bankruptcy. You should not pay it off. It is not likely to survive since I would consider Capital One (Bank) to be a sophisticated creditor.

    I would not expect it to stay open, nor would I touch it, pay it, or think about using it.

      I hass one that still showed a balance. I disputed it and it was fixed. Was it listed on your discharge notice?

        I did list it on my original paperwork but I will need to check on the paperwork for the 341 hearing.

          Do not do anything. It generally can take 30-60 days for the creditor to report the "new" status to the credit bureaus. It has only been a few weeks. It will probably be updated by 1/1/2025 and would certainly be updated within 30 days of your discharge.

          I wouldn't do anything right now. Just get through discharge.

            Hi! It’s completely normal to feel a bit anxious while waiting for your discharge. As for the Capital One account still showing open, this can sometimes happen because creditors don’t always update account statuses right away. They might still be processing your bankruptcy filing, which could explain the delay. In most cases, the account will be closed once your discharge is finalized. Regarding the balance, if the account was included in your Chapter 7 filing, it’s likely covered under the discharge. It’s generally best not to make any payments unless your attorney has specifically advised otherwise.
