    Foreclosure lawsuit..

    Foreclosure 101 I'm sure, but I feel like I have read that being sued is apart of the foreclosure process in some states, but is there anything we need to do? I received the summons past the date it says that I am directed to file a written answer..

    You should have twenty to thirty days AFTER you receive your summons. If you want to stay in the home, then hire an attorney immediately. If you do not wish to keep your home, depending on the state you live, ride it out and save your money.

      i know many that wanted to stay and just went to court on their own. also you must answer the summons (some states are 30 days some differ, so check the summons) answer it if you intend to fight the foreclosure, however, do nothing if you intend to leave.

      we got our summons didn't bother to do a thing. by the way that almost 5 years ago now and our property is STILL not foreclosed on. so it's also going to depend on what state you are in. which i believe you are not as lucky as kmattin and myself who are in judicial states...i believe maryland is or may be both, so the process goes much quicker as it doesn't usually have to go through the courts.

        Oh okay, good to know, whoever can have the nightmare of a house, we have moved on and hope to have it out of our names sooner than later! Wow, Tobee, what's the holdup? The house is in Oklahoma..

          oh i think oklahoma is a judicial state, which means it will take a bit of time so, if you had intended to leave i would stay and NOT pay up until you must leave, if that's your plan. but since you left, i guess it doesn't matter.

          well, our old property was in new jersey...jokes a side we lived in a lovely area. but the house which was once beautiful began to flood every spring when the town came in a changed a curb in the road...it diverted the water straight for our house. we managed it for years, but without care for even a year, i'm certain it became overrun with black mold. last we heard there was a tree growing on the first floor, so i guess chase is having a difficult time showing a house when the only visible furniture is a wild tree
