    NOTICE OF PROPOSED FINAL ORDER OF DISMISSAL????? Florida

    OK so I ssume since Chase has not done anything on my case in over a year this means that the courts will dismiss the case? Nothing in the mail just saw this on line.

    ORDER SETTING HEARING FOR 12/21/2012 9:00 AM

    I did spend over two years trying to get a mod and got rejected about 2 months ago. Lots of wasted paperwork, faxes and time!

    It looks like the case will be dismissed unless Chase convinces the judge there is a good reason for their delay in moving the case forward. Chase might use the modification negotiations as a reason.

      So does that mean Chase cant move forward until after the 12/21 court date? Just trying to plan my living arrangements.

        it means they have until 12/21 to move on the case or it will be dismissed on the end of the that court date.

        i'm surprised you got chase to move at all. i'm still waiting about 4.5 years and nothing. it would be great if that happens, i'm wondering if that means you can keep your house. i will keep my fingers crossed for you. also i would check with an atty. i don't know if they can refile or what the statue is here in florida or how many times they can file.

          wow tobee - i think you are nearing the SOL depending on a few details of when you last acknowledged the debt, etc. Are you planning on using that as a defense or to strip the mtg completely? I am curious as to how that would turn out - we are also evaluating some options similar to this.

            oh, how i wish! the statue of limitation is 20 years where we own the property. each state is different, so chase doesn't have to do anything at all, really ever. i will never be SOL in my lifetime .

              DARN!

              I dont know if you have been watching my post, but we are thinking of reopening to strip ch7 with the middle district following the rulings from http://www.stayinmyhome.com/blog/wp-...nd-in-CH-7.pdf - I am in the last stages of picking my atty (my other one had a heart attack and isnt practicing for a year...) and learned that they denied a hearing to the creditor in the above case just recently. If it doesnt go thru bk, we will try to use SOL. I will let you know how it turns out.
