    Attorney fees after foreclosure?

    Hi everyone,

    After not paying the mortgage for 2 1/2 years, we FINALLY got the Notice of Default/Acceleration yesterday with a pay up by Nov 24 or FC will commence. It's a standard letter and in the body of the letter it talks about attorney fees being our responsibility? Has anyone ever had to pay this (or any other bank fee for that matter) after the FC has completed? Just wondering...

    As a background, we surrendered our house 5 months into our CH13 through a modification to our plan. BOA never filed a claim so any deficiency that would have been unsecured was not claimed. Our ch13 discharge was on July25th and finally, F I N A L L Y, the ball is rolling on the FC. Can't wait to get this monkey off my back.

    That is standard language. It was in mine. It comes out of any equity in the house or submitted as a claim through insurance. The only thing that survives a BK discharge is the lien on the property.

      Thanks...that's what I thought but now that everything is starting to happen I'm second guessing myself...
