    sheriff sale tomorrow

    Hi everyone,

    My sheriff sale is tomorrow. I'd like to attend to see what happens but I have to work and can't go. How can I find out if it sells and who bought it? Also, when I do move out, which is in about a month, I'd like to contact the person or bank who bought it to let them know they must have the electric on or the basement will flood the next time it rains hard since the sump pump won't work. I might have lost it but I still don't want the house to get trashed. Thanks.

    i'm certain they will notify you by writing as to when you have to leave.

    i know this is difficult leaving your home. it was for us after over 30 years even though there was a ton of heart ache associated with it, it was where i walked our children through the front door when they were born and watched the shut the door when they left for college. bittersweet to say the least. the fact you are concerned about the flooding shows it's hard for you. but after the sale today the sump pump situation is no longer your problem.

    all i can say, is we haven't looked back and it was the best decision we made was to leave that house. i would just be all packed up and ready to go, i don't know the legal process in MI but i would call the sheriff's office to find out what the procedure is now. i know usually that they are somewhat helpful with explaining the process to you, as they are the enforcers for the bank.

      When the sheriff sale for our home happened, I just called the sheriff's office in the late afternoon the day of the sale, they put me through to a woman who told me that the bank had bought our house and the amount that they paid for it. You can do that if you don't want to or/can't attend the sale.

        I'm glad it worked out for you Tobee. After 30 years it must really have been hard. We've only been here 10. Tonight my wife and I were talking how we can't believe we only have three more weeks here and both of us started getting a little mist eyed. But I guess life goes on and I still have bigger problems than my house.

        Toby, I'll try calling tomorrow. Do I actually call the sheriff's office of this county? Thanks

          Yes, just call the sheriff's office and say you want to know if the property sold, they will put you through to the department that has that information. If the bank buys it back, they may offer you cash for keys (or as they call it relocation assistance.) They offered us 3K if we were out within 30 days and 2k if out in 60 days. We took the 60 day option, we moved in Feb. 2012, it was an ordeal cleaning out 20 years of stuff but it was a cleansing of sorts, like the start of a new beginning. We have adapted to our new place, much smaller, but life is very good. Hope all goes well for you, just know you are not alone, this is happening to millions of families. Thank heaven we can all start over again.

            we just rode off in the sunset knowing our memories are in our hearts and not 4 walls and some brick. all the problems will slowly start to fade away as well and you'll get your new start and it will be wonderful!

              Sadly, my biggest problem is my wife's health and unfortunately, I'm not very optimistic she will ever get better. She's only 35....

              The house sold yesterday to WF. There were no other bids. At least the three year clock on a refinance on my six year land contract is ticking now. The timing couldn't have been better. I would hope in six years I could get a mortgage....

              For my fellow Michiganders, which many of seem to be here, this is the time frame for me in the Western District and my house in the GR area....

              Stopped paying around June 2011, filed Ch 7 July 2011, 341 Aug 2011, discharged Nov 2011, closed Jan 2012, sheriff sale May 2012. Best of luck to all of you.

                In Michigan, the redemption period is six months after sheriff sale. You can live in the home during that time. Longer may be possible dependant on property size. Look up Michigan foreclosure laws.


                I believe the sheriff deed is not effective until the expiration of the redemption period. IF this is true, I believe your foreclosure date is the date the deed is effective. Based on "The redemption period varies but adeed issued as part of a foreclosure only effectuates a transfer after the expiration of the redemption period." from below.

                Is there a right of redemption in Michigan?

                Michigan has astatutory right of redemption, which would allow a party whose property has been foreclosed to reclaim that property by making payment in full of the sum of the unpaid loan plus costs. The redemption period varies but adeed issued as part of a foreclosure only effectuates a transfer after the expiration of the redemption period.

                Power of Sale Notice Requirements:

                If the property is residential and does not exceed four (4) units and is not more than 3 acres, if the defaulted amount at the date of the notice of foreclosure is more than 2/3 of the original face amount of the debt secured by the mortgage, the redemption period is six (6) months.
                If the property is abandoned based on either a personal inspection conducted by the lender or a statutory mailed notice asserting abandonment which has not been responded to by borrower, the redemption period is shortened to thirty (30) days.
                In all other cases the redemption period is one (1) year. The redemption payoff includes the amount of the bid at the time of the foreclosure sale, interest at the note rate for the mortgage, and any taxes or hazard insurance paid with respect to the property after the foreclosure sale up until the date of redemption.
                Mortgagors who do not redeem but remain upon the foreclosed property after foreclosure sale can be evicted through a summary proceeding in district court which usually takes thirty (30) days

                  I have a six month redemption period but I'll be out in 3 weeks. I thought I was completely done with this house then, ie utilities, lawn, etc. You mean I have to take care of this until six months or until the bank actually takes it over? How would I know when the bank takes possession after I move out? Cripes, I thought this was over. The house sold for $166k. I owed $190k plus another $24k HELOC. A lady at the sheriffs office told my wife that since it was a VA loan we could work with them to refinance at $166k. If that is true I'd been better off than buying my new house on land contract.

                    if you want to stay, that's would be a great opportunity, if you can work with the VA! especially, if you want to stay.

                        That is interesting about the VA thing, Miknan. I wonder how difficult that would be...
