We stopped paying our mortgage and files for Ch 7 (mortgage was IIB) in June 2010 and our discharge was in Sept 2010. Just last week we received a letter from the lender denying our request for a loan mod.
OK is a non-judicial state, but I've found conflicting info on whether most foreclosures are done through the courts or not. I'm going to assume it will be non-judicial just to be on the safe side. Either way, we'd like to stay in our house as long as possible.
So far, we have only received a couple informal letters from the lender stating the amount of our deficiency. There was some language about paying the amount by a certain date or they "may" begin foreclosure. This was while they were still processing the loan mod so I didn't take this as any sort of notification that they had started the process. Is there any way to know when the foreclosure starts or do you just have to wait for the Notice of Sale? We're freaking out a bit at the prospect of only having ~30 days to find a new place and move. Is it worth calling the lender to check on the status of things or would that just keep on on their radar?
